  1.1                          A bill for an act
  1.2             relating to crime; permitting judges to base 
  1.3             departures from the presumptive sentence under the 
  1.4             sentencing guidelines on an offender's prior record of 
  1.5             juvenile offenses. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [SENTENCING GUIDELINES MODIFICATION.] 
  1.8      The sentencing guidelines commission shall modify 
  1.9   sentencing guideline II.D.2 to permit a sentencing judge to base 
  1.10  a departure from the presumptive sentence on an offender's prior 
  1.11  record of juvenile offenses, excluding those juvenile offenses 
  1.12  that are included in the offender's criminal history score.  The 
  1.13  commission shall apply the modification to crimes that are 
  1.14  committed on or after August 1, 1998.
