  2.35     We, the undersigned conferees for H.F. No. 3163, report 
  2.36  that we have agreed upon the items in dispute and recommend as 
  2.37  follows: 
  2.38     
  2.39     That the House concur in the Senate amendments and that 
  2.40  H.F. No. 3163, the first unofficial engrossment, be further 
  2.41  amended as follows: 
  2.42     Pages 4 and 5, delete section 8 and insert: 
  2.43     "Sec. 8.  Minnesota Statutes 2001 Supplement, section 
  2.44  16A.151, is amended by adding a subdivision to read: 
  2.45     Subd. 5.  [EXPIRATION.] This section expires June 30, 2004."
  2.46     Page 21, after line 33, insert: 
  2.47     "Sec. 42.  Minnesota Statutes 2000, section 122A.20, 
  2.48  subdivision 1, is amended to read: 
  2.49     Subdivision 1.  [GROUNDS FOR REVOCATION, SUSPENSION, OR 
  2.50  DENIAL.] (a) The board of teaching or the commissioner, with the 
  2.51  advice from an advisory task force of supervisory personnel 
  2.52  established under section 15.014 board of school administrators, 
  3.1   whichever has jurisdiction over a teacher's licensure, may, on 
  3.2   the written complaint of the school board employing a teacher, a 
  3.3   teacher organization, or any other interested person, refuse to 
  3.4   issue, refuse to renew, suspend, or revoke a teacher's license 
  3.5   to teach for any of the following causes: 
  3.6      (1) Immoral character or conduct; 
  3.7      (2) Failure, without justifiable cause, to teach for the 
  3.8   term of the teacher's contract; 
  3.9      (3) Gross inefficiency or willful neglect of duty; or 
  3.10     (4) Failure to meet licensure requirements; or 
  3.11     (5) Fraud or misrepresentation in obtaining a license. 
  3.12     The written complaint must specify the nature and character 
  3.13  of the charges.  
  3.14     (b) The board of teaching or the commissioner of children, 
  3.15  families, and learning board of school administrators whichever 
  3.16  has jurisdiction over a teacher's licensure, shall refuse to 
  3.17  issue, refuse to renew, or automatically revoke a teacher's 
  3.18  license to teach without the right to a hearing upon receiving a 
  3.19  certified copy of a conviction showing that the teacher has been 
  3.20  convicted of child abuse, as defined in section 609.185, or 
  3.21  sexual abuse under section 609.342, 609.343, 609.344, 609.345, 
  3.22  609.3451, subdivision 3, or 617.23, subdivision 3, or under a 
  3.23  similar law of another state or the United States.  The board 
  3.24  shall send notice of this licensing action to the district in 
  3.25  which the teacher is currently employed. 
  3.26     (c) A person whose license to teach has been revoked, not 
  3.27  issued, or not renewed under paragraph (b), may petition the 
  3.28  board to reconsider the licensing action if the person's 
  3.29  conviction for child abuse or sexual abuse is reversed by a 
  3.30  final decision of the court of appeals or the supreme court or 
  3.31  if the person has received a pardon for the offense.  The 
  3.32  petitioner shall attach a certified copy of the appellate 
  3.33  court's final decision or the pardon to the petition.  Upon 
  3.34  receiving the petition and its attachment, the board shall 
  3.35  schedule and hold a disciplinary hearing on the matter under 
  3.36  section 214.10, subdivision 2, unless the petitioner waives the 
  4.1   right to a hearing.  If the board finds that, notwithstanding 
  4.2   the reversal of the petitioner's criminal conviction or the 
  4.3   issuance of a pardon, the petitioner is disqualified from 
  4.4   teaching under paragraph (a), clause (1), the board shall affirm 
  4.5   its previous licensing action.  If the board finds that the 
  4.6   petitioner is not disqualified from teaching under paragraph 
  4.7   (a), clause (1), it shall reverse its previous licensing action. 
  4.8      (d) For purposes of this subdivision, the board of teaching 
  4.9   is delegated the authority to suspend or revoke coaching 
  4.10  licenses." 
  4.11     Page 24, after line 34, insert: 
  4.12     "Sec. 45.  Minnesota Statutes 2001 Supplement, section 
  4.13  125A.09, subdivision 3, is amended to read: 
  4.14     Subd. 3.  [INITIAL ACTION; PARENT CONSENT.] (a) The 
  4.15  district must not proceed with the initial formal assessment 
  4.16  evaluation of a child, the initial placement of a child in a 
  4.17  special education program, or the initial provision of special 
  4.18  education services for a child without the prior written consent 
  4.19  of the child's parent or guardian.  The refusal of a parent or 
  4.20  guardian to consent to an initial evaluation or reevaluation may 
  4.21  be overridden by the decision in a hearing held pursuant to 
  4.22  subdivision 6 at the district's initiative. 
  4.23     (b) A parent, after consulting with health care, education, 
  4.24  or other professional providers, may agree or disagree to 
  4.25  provide the parent's child with sympathomimetic medications 
  4.26  unless section 144.344 applies." 
  4.27     Renumber the sections in sequence and correct the internal 
  4.28  references 
  4.29     Amend the title as follows: 
  4.30     Page 1, line 23, after "6;" insert "122A.20, subdivision 1;"
  4.31     Page 1, line 44, after the first semicolon, insert
