A bill for an act
relating to water; establishing the "Bottled Water Right-to-Know Act"; adding
labeling requirements for bottled water; proposing coding for new law in
Minnesota Statutes, chapter 31.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin This section may be cited as the "Bottled Water Right-to-Know
Act."

new text begin Definition. new text end

new text begin For the purposes of this section, "bottled water" means water
that is intended for human consumption and that is sealed in bottles or other containers with
no added ingredients, except that it may contain safe and suitable antimicrobial agents.

new text begin No person shall sell, offer for sale, or
possess with intent to sell, bottled water unless the following information is printed
legibly and prominently on its label, an additional label affixed to the container, or on
a package insert or attachment:

new text begin (1) the source of the bottled water, in compliance with applicable state and federal
regulations;

new text begin (2) the following statement: "THE U.S. FOOD AND DRUG ADMINISTRATION'S
QUALITY AND TESTING FREQUENCY REQUIREMENTS FOR BOTTLED WATER
IN INTERSTATE COMMERCE ARE GENERALLY LESS RIGOROUS THAN THOSE
ENFORCED BY THE U.S. ENVIRONMENTAL PROTECTION AGENCY FOR
PUBLIC TAP WATER."

new text begin No person shall sell, offer for sale,
or possess with intent to sell, bottled water containing water obtained from waters of the
state, as defined in section 103G.005, subdivision 17, unless the following statement is
printed legibly and prominently on its label, an additional label affixed to the container,
or on a package insert or attachment: "PACKAGING AND/OR SALE OF WATERS
OF THE STATE OF MINNESOTA BY A PRIVATE PARTY DOES NOT CONVEY
OWNERSHIP OF WATERS OF THE STATE TO THE PARTY. CONSISTENT WITH
MINNESOTA LAW, THE STATE COMMISSIONER OF NATURAL RESOURCES
SHALL ADMINISTER THE USE, ALLOCATION, AND CONTROL OF WATERS OF
THE STATE IN THE PUBLIC INTEREST."
