  1.1                          A bill for an act
  1.2             relating to health; establishing requirements for 
  1.3             directors of nursing; amending Minnesota Statutes 
  1.4             1994, section 144A.04, by adding a subdivision. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 144A.04, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 7a.  [DIRECTOR OF NURSING.] Except as otherwise 
  1.9   provided by this subdivision, a nursing home must have a 
  1.10  full-time director of nursing services who is assigned full time 
  1.11  to the nursing services of the home.  For purposes of this 
  1.12  requirement, "full time" means working at least 35 hours per 
  1.13  week.  The director of nursing of a nursing home may also serve 
  1.14  as the director of nursing of a physically attached hospital if: 
  1.15     (1) the hospital has an average daily census of ten or less 
  1.16  patients in the most recent reporting year for which data is 
  1.17  available; 
  1.18     (2) the total combined beds of the hospital and nursing 
  1.19  home do not exceed 100; and 
  1.20     (3) the management of the two facilities is under the 
  1.21  control and direction of the same governing body.
