  1.1                          A bill for an act 
  1.2             relating to crime; increasing certain penalties 
  1.3             associated with malicious punishment of children; 
  1.4             directing the Sentencing Guidelines Commission to rank 
  1.5             offenses at specified severity levels; amending 
  1.6             Minnesota Statutes 2002, section 609.377, subdivisions 
  1.7             5, 6. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 609.377, 
  1.10  subdivision 5, is amended to read: 
  1.11     Subd. 5.  [FELONY; SUBSTANTIAL BODILY HARM.] If the 
  1.12  punishment results in substantial bodily harm, the person may be 
  1.13  sentenced to imprisonment for not more than five ten years or to 
  1.14  payment of a fine of not more than $10,000, or both. 
  1.15     [EFFECTIVE DATE.] This section is effective August 1, 2004, 
  1.16  and applies to crimes committed on or after that date. 
  1.17     Sec. 2.  Minnesota Statutes 2002, section 609.377, 
  1.18  subdivision 6, is amended to read: 
  1.19     Subd. 6.  [FELONY; GREAT BODILY HARM.] If the punishment 
  1.20  results in great bodily harm, the person may be sentenced to 
  1.21  imprisonment for not more than ten 20 years or to payment of a 
  1.22  fine of not more than $20,000, or both. 
  1.23     [EFFECTIVE DATE.] This section is effective August 1, 2004, 
  1.24  and applies to crimes committed on or after that date. 
  1.25     Sec. 3.  [SENTENCING GUIDELINES MODIFICATION.] 
  1.26     The Sentencing Guidelines Commission shall modify the 
  2.1   sentencing guidelines to take effect January 1, 2005, by ranking 
  2.2   violations of Minnesota Statutes, section 609.377, subdivision 
  2.3   5, (malicious punishment of a child) in severity level VIII of 
  2.4   the sentencing guidelines grid and ranking violations of 
  2.5   Minnesota Statutes, section 609.377, subdivision 6, (malicious 
  2.6   punishment of a child) in severity level IX of the sentencing 
  2.7   guidelines grid. 
  2.8      [EFFECTIVE DATE.] This section is effective July 1, 2004.
