  1.1                          A bill for an act 
  1.2             relating to unemployment insurance; modifying 
  1.3             requirements for additional unemployment benefits; 
  1.4             amending Minnesota Statutes 2000, section 268.125, 
  1.5             subdivisions 3, 5; repealing Minnesota Statutes 2000, 
  1.6             section 268.125, subdivision 1. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 268.125, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [ELIGIBILITY CONDITIONS.] An applicant is 
  1.11  eligible to receive additional unemployment benefits for any 
  1.12  week during the applicant's benefit year if:  
  1.13     (1) the applicant was laid off from employment as a result 
  1.14  of a reduction under subdivision 1 or was laid off due to lack 
  1.15  of work from that employer during the three-month period before, 
  1.16  or the three-month period after, the month of the reduction 
  1.17  under subdivision 1; 
  1.18     (2) the applicant meets the eligibility requirements under 
  1.19  section 268.085; 
  1.20     (3) the applicant is not subject to a disqualification 
  1.21  under section 268.095; for the purpose of this subdivision, the 
  1.22  disqualifying conditions in section 268.095, and the 
  1.23  requalifying requirements, apply to the receipt of additional 
  1.24  unemployment benefits; 
  1.25     (4) (3) the applicant has exhausted regular unemployment 
  1.26  benefits under section 268.07, is not entitled to receive 
  2.1   extended unemployment benefits under section 268.115, and is not 
  2.2   entitled to receive unemployment benefits under any other state 
  2.3   or federal law for that week; 
  2.4      (5) a majority of the applicant's wage credits were from 
  2.5   the employer that had a reduction in operations under 
  2.6   subdivision 1. 
  2.7      [EFFECTIVE DATE.] This section is effective the day 
  2.8   following final enactment and applies retroactively to 
  2.9   applicants who have exhausted benefits on or after January 1, 
  2.10  2002. 
  2.11     Sec. 2.  Minnesota Statutes 2000, section 268.125, 
  2.12  subdivision 5, is amended to read: 
  2.13     Subd. 5.  [MAXIMUM AMOUNT OF UNEMPLOYMENT BENEFITS.] The 
  2.14  maximum amount of additional unemployment benefits available in 
  2.15  the applicant's benefit year shall be one-half of the 
  2.16  applicant's maximum amount of regular unemployment benefits 
  2.17  available under section 268.07, subdivision 2.  The maximum 
  2.18  amount of additional benefits available is 26 times the 
  2.19  applicant's weekly additional unemployment benefits amount.  
  2.20  Extended unemployment benefits paid and unemployment benefits 
  2.21  paid under any federal law other than regular unemployment 
  2.22  benefits shall be deducted from the maximum amount of additional 
  2.23  unemployment benefits available. 
  2.24     [EFFECTIVE DATE.] This section is effective the day 
  2.25  following final enactment and applies retroactively to 
  2.26  applicants who have exhausted benefits on or after January 1, 
  2.27  2002. 
  2.28     Sec. 3.  [REPEALER.] 
  2.29     Minnesota Statutes 2000, section 268.125, subdivision 1, is 
  2.30  repealed. 
  2.31     [EFFECTIVE DATE.] This section is effective the day 
  2.32  following final enactment and applies retroactively to 
  2.33  applicants who have exhausted benefits on or after January 1, 
  2.34  2002.
