1.1 A bill for an act 1.2 relating to transportation; allocating money to the 1.3 highway user tax distribution fund and the transit 1.4 assistance fund from proceeds of the tax on the sale 1.5 of motor vehicles; amending Minnesota Statutes 1996, 1.6 sections 174.32, subdivision 2; and 297B.09, 1.7 subdivision 1. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 1996, section 174.32, 1.10 subdivision 2, is amended to read: 1.11 Subd. 2. [TRANSIT ASSISTANCE FUND; DISTRIBUTION.] The 1.12 transit assistance fund receives money distributed under section 1.13 297B.09.EightySeventy-five percent of the receipts of the 1.14 fund must be placed into a metropolitan account for distribution 1.15 to recipients located in the metropolitan area and2025 percent 1.16 into a separate account for distribution to recipients located 1.17 outside of the metropolitan area. Except as otherwise provided 1.18 in this subdivision, the metropolitan council is responsible for 1.19 distributing assistance from the metropolitan account, and the 1.20 commissioner is responsible for distributing assistance from the 1.21 other account. 1.22 Sec. 2. Minnesota Statutes 1996, section 297B.09, 1.23 subdivision 1, is amended to read: 1.24 Subdivision 1. [GENERAL FUND SHARE.] (a) Money collected 1.25 and received under this chapter must be deposited in the state 1.26 treasury and credited to the general fund. The amounts 2.1 collected and received shall be credited as provided in this 2.2 subdivision, and transferred from the general fund on July 15 2.3 and February 15 of each fiscal year. The commissioner of 2.4 finance must make each transfer based upon the actual receipts 2.5 of the preceding six calendar months and include the interest 2.6 earned during that six-month period. The commissioner of 2.7 finance may establish a quarterly or other schedule providing 2.8 for more frequent payments to the transit assistance fund if the 2.9 commissioner determines it is necessary or desirable to provide 2.10 for the cash flow needs of the recipients of money from the 2.11 transit assistance fund. 2.12 (b)Twenty-fiveFifty percent of the money collected and 2.13 received under this chapter after June 30,1990, and before July2.141, 19911998, must be transferred to the highway user tax 2.15 distribution fund and the transit assistance fund for 2.16 apportionment as follows: 75 percent must be transferred to the 2.17 highway user tax distribution fund for apportionment in the same 2.18 manner and for the same purposes as other money in that fund, 2.19 and the remaining 25 percent of the money must be transferred to 2.20 the transit assistance fund to be appropriated to the 2.21 commissioner of transportation for transit assistance within the 2.22 state and to the metropolitan council. 2.23(c) The distributions under this subdivision to the highway2.24user tax distribution fund until June 30, 1991, and to the trunk2.25highway fund thereafter, must be reduced by the amount necessary2.26to fund the appropriation under section 41A.09, subdivision 1.2.27For the fiscal years ending June 30, 1988, and June 30, 1989,2.28the commissioner of finance, before making the transfers2.29required on July 15 and January 15 of each year, shall estimate2.30the amount required to fund the appropriation under section2.3141A.09, subdivision 1, for the six-month period for which the2.32transfer is being made. The commissioner shall then reduce the2.33amount transferred to the highway user tax distribution fund by2.34the amount of that estimate. The commissioner shall reduce the2.35estimate for any six-month period by the amount by which the2.36estimate for the previous six-month period exceeded the amount3.1needed to fund the appropriation under section 41A.09,3.2subdivision 1, for that previous six-month period. If at any3.3time during a six-month period in those fiscal years the amount3.4of reduction in the transfer to the highway user tax3.5distribution fund is insufficient to fund the appropriation3.6under section 41A.09, subdivision 1, for that period, the3.7commissioner shall transfer to the general fund from the highway3.8user tax distribution fund an additional amount sufficient to3.9fund the appropriation for that period, but the additional3.10amount so transferred to the general fund in a six-month period3.11may not exceed the amount transferred to the highway user tax3.12distribution fund for that six-month period.3.13 Sec. 3. [EFFECTIVE DATE.] 3.14 Sections 1 and 2 are effective July 1, 1998.
