  1.1                          A bill for an act 
  1.2             relating to health; establishing an asthma 
  1.3             surveillance system; appropriating money; amending 
  1.4             Minnesota Statutes 2001 Supplement, section 13.3806, 
  1.5             by adding a subdivision; proposing coding for new law 
  1.6             in Minnesota Statutes, chapter 144. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2001 Supplement, section 
  1.9   13.3806, is amended by adding a subdivision to read: 
  1.10     Subd. 9a.  [ASTHMA SURVEILLANCE SYSTEM.] Data collected by 
  1.11  the asthma surveillance system are classified under section 
  1.12  144.4105, subdivision 2. 
  1.13     Sec. 2.  [144.4105] [ASTHMA SURVEILLANCE SYSTEM.] 
  1.14     Subdivision 1.  [ESTABLISHMENT.] The commissioner of health 
  1.15  shall develop a comprehensive asthma surveillance system to: 
  1.16     (1) measure the prevalence of childhood asthma; 
  1.17     (2) identify factors, including indoor and outdoor 
  1.18  environmental factors, which may cause or exacerbate asthma; 
  1.19     (3) identify appropriate and effective methods of 
  1.20  intervention to prevent or minimize the severity of asthma; and 
  1.21     (4) provide data for utilization by other asthma 
  1.22  researchers. 
  1.23     Subd. 2.  [DATA COLLECTION; DATA CLASSIFICATION.] The 
  1.24  commissioner shall specify the types of data that must be 
  1.25  reported to the commissioner and standards for reporting 
  1.26  specific types of data.  Data collected and maintained by the 
  2.1   commissioner for the asthma surveillance system under this 
  2.2   section are private data on individuals.  Notwithstanding this 
  2.3   classification, the commissioner may release data collected and 
  2.4   maintained in the system according to subdivision 1, clause (4). 
  2.5      Subd. 3.  [RULEMAKING.] The commissioner may adopt rules to 
  2.6   implement this section. 
  2.7      Subd. 4.  [BIENNIAL REPORT TO LEGISLATURE.] By January 15, 
  2.8   2003, 2005, and 2007, the commissioner shall report to the 
  2.9   legislature on the prevalence of asthma in the state and shall 
  2.10  provide recommendations on action steps the legislature may take 
  2.11  to decrease the prevalence of asthma and the morbidity 
  2.12  associated with having asthma. 
  2.13     Sec. 3.  [APPROPRIATION.] 
  2.14     $....... is appropriated for the 2003 fiscal year from the 
  2.15  children's account in the general fund to the commissioner of 
  2.16  health to establish an asthma surveillance system and provide 
  2.17  reports to the legislature according to section 2.
