  1.1                          A bill for an act
  1.2             relating to checks; prohibiting a person from 
  1.3             requiring a social security number as a condition of 
  1.4             acceptance of a check; providing that prosecutors may 
  1.5             not refuse to prosecute a dishonored check case solely 
  1.6             because the dishonored check does not contain the 
  1.7             issuer's social security number; amending Minnesota 
  1.8             Statutes 1996, section 325F.981, subdivision 1; and 
  1.9             section 609.535, by adding a subdivision. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 1996, section 325F.981, 
  1.12  subdivision 1, is amended to read: 
  1.13     Subdivision 1.  [PROVISION OF CREDIT CARD NUMBER OR SOCIAL 
  1.14  SECURITY NUMBER.] A person shall not require as a condition of 
  1.15  acceptance of a check, or as a means of identification, that the 
  1.16  person presenting the check provide a credit card number or 
  1.17  social security number. 
  1.18     Sec. 2.  Minnesota Statutes 1996, section 609.535, is 
  1.19  amended by adding a subdivision to read: 
  1.20     Subd. 9.  [PROSECUTION.] A prosecutor may not refuse to 
  1.21  prosecute a case under this section solely because the 
  1.22  dishonored check does not contain the issuer's social security 
  1.23  number. 
  1.24     Sec. 3.  [EFFECTIVE DATE.] 
  1.25     Sections 1 and 2 are effective August 1, 1998, and apply to 
  1.26  crimes committed on or after that date.
