A bill for an act
relating to health; making certain nursing home license applications public;
amending Minnesota Statutes 2018, section 144A.02, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 144A.02, is amended by adding a subdivision
to read:

new text begin Public data and comments from the public. new text end

new text begin Notwithstanding the provisions
in section 13.41, all completed initial and change of ownership nursing home license
applications are public data. The commissioner shall make all completed initial and change
of ownership nursing home license applications available for review by anyone who makes
a request. After the initial and change of ownership nursing home license application is
complete, the commissioner shall publish on the department's website notice that the
application is complete. For 14 calendar days thereafter, anyone from the public may submit
comments, information, or other data for consideration by the commissioner before the
commissioner takes action on the nursing home license application. The submitted comments,
information, or other data are confidential data under section 13.02, subdivision 3, and
cannot be released at any time except when it is relevant as part of a nursing home license
review procedure on whether the commissioner's action on the nursing home license
application was justified.
