  1.1                          A bill for an act 
  1.2             relating to education; permitting district 
  1.3             transportation for late school activities; providing 
  1.4             restrictions for pupils driving private vehicles to 
  1.5             school; appropriating money; amending Minnesota 
  1.6             Statutes 1995 Supplement, sections 123.39, subdivision 
  1.7             1; and 124.223, by adding a subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1995 Supplement, section 
  1.10  123.39, subdivision 1, is amended to read: 
  1.11     Subdivision 1.  The board may shall provide for the 
  1.12  transportation of pupils to and from school and for any other 
  1.13  school-related purpose.  The board may also provide for the 
  1.14  transportation of pupils to schools in other districts for 
  1.15  grades and departments not maintained in the district, including 
  1.16  high school, at the expense of the district, when funds are 
  1.17  available therefor and if agreeable to the district to which it 
  1.18  is proposed to transport the pupils, for the whole or a part of 
  1.19  the school year, as it may deem advisable, and subject to its 
  1.20  rules.  In any school district, the board shall arrange for the 
  1.21  attendance of all pupils living two miles or more from the 
  1.22  school, except pupils whose transportation privileges have been 
  1.23  revoked under section 123.805, subdivision 1, clause (6), or 
  1.24  123.7991, paragraph (b), through suitable provision for 
  1.25  transportation or through the boarding and rooming of the pupils 
  1.26  who may be more economically and conveniently provided for by 
  2.1   that means.  The board shall provide transportation to and from 
  2.2   the home of a child with a disability not yet enrolled in 
  2.3   kindergarten when special instruction and services under 
  2.4   sections 120.17 and 120.1701 are provided in a location other 
  2.5   than in the child's home.  When transportation is provided, 
  2.6   scheduling of routes, establishment of the location of bus 
  2.7   stops, manner and method of transportation, control and 
  2.8   discipline of school children and any other matter relating 
  2.9   thereto shall be within the sole discretion, control, and 
  2.10  management of the school board.  The district may provide for 
  2.11  the transportation of pupils or expend a reasonable amount for 
  2.12  room and board of pupils whose attendance at school can more 
  2.13  economically and conveniently be provided for by that means or 
  2.14  who attend school in a building rented or leased by a district 
  2.15  within the confines of an adjacent district.  The district may 
  2.16  make reasonable arrangements to accommodate pupil transportation 
  2.17  needs for evening school activities including, but not limited 
  2.18  to:  
  2.19     (1) rearranging school or activity schedules; 
  2.20     (2) examining the possibility of providing small school 
  2.21  vehicles to accommodate smaller numbers of pupils requiring 
  2.22  transportation; or 
  2.23     (3) requiring that a pupil shall not drive a private 
  2.24  vehicle to school except when the pupil is employed after 
  2.25  school, the school bus schedule does not accommodate the pupil's 
  2.26  work schedule, and a written statement by the pupil's parent or 
  2.27  guardian and employer stating the pupil's need for private 
  2.28  transportation to go to work is on file at the school. 
  2.29     Sec. 2.  Minnesota Statutes 1995 Supplement, section 
  2.30  124.223, is amended by adding a subdivision to read: 
  2.31     Subd. 10a.  [LATE ACTIVITY BUSES.] School districts may 
  2.32  provide late transportation home from school, between schools 
  2.33  within a district, or between schools in one or more districts 
  2.34  for pupils involved in after school activities. 
  2.35     Sec. 3.  [APPROPRIATION.] 
  2.36     $....... is appropriated from the general fund in fiscal 
  3.1   year 1997 to the department of children, families, and learning 
  3.2   for the purposes of sections 1 and 2.
