  1.1                          A bill for an act 
  1.2             relating to natural resources; requiring an exchange 
  1.3             of revenue producing state land for certain nonrevenue 
  1.4             producing permanent school fund lands; requiring 
  1.5             reimbursement for lost revenue. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [EXCHANGE AND REIMBURSEMENT REQUIRED.] 
  1.8      Subdivision 1.  [EXCHANGE OF LAND.] The commissioner of 
  1.9   natural resources shall exchange permanent school fund lands, as 
  1.10  defined in the Minnesota Constitution, article XI, section 8, 
  1.11  that are located in state forests or other units administered by 
  1.12  the commissioner and that do not produce revenue for state lands 
  1.13  that produce revenue and that are compatible with the goal of 
  1.14  the permanent school fund lands in Minnesota Statutes, section 
  1.15  127A.31.  Whenever possible, the exchanged land parcels shall be 
  1.16  located in the same county. 
  1.17     Subd. 2.  [REIMBURSEMENT FOR LOST REVENUE.] The 
  1.18  commissioner of natural resources shall pay to the permanent 
  1.19  school fund an amount equal to the unrealized revenue for each 
  1.20  parcel of permanent school fund land exchanged under subdivision 
  1.21  1.  The unrealized revenue shall be determined on a per acre 
  1.22  basis by multiplying the average return per acre of state forest 
  1.23  land during the last three years by the number of years that the 
  1.24  affected parcel of permanent school fund land has been 
  1.25  administered by the commissioner of natural resources without 
  2.1   producing revenue. 
  2.2      Subd. 3.  [PROCEDURE; TRUST STATUS.] The commissioner of 
  2.3   natural resources shall make the exchange under subdivision 1 
  2.4   according to the Minnesota Constitution, article XI, section 10, 
  2.5   and Minnesota Statutes, sections 94.342, subdivision 5, and 
  2.6   94.343, subdivision 1.  State land exchanged is subject to the 
  2.7   same trust as the permanent school fund land for which it was 
  2.8   exchanged. 
  2.9      Subd. 4.  [DEADLINE.] The commissioner of natural resources 
  2.10  shall complete the exchange required under subdivision 1 no 
  2.11  later than one year after the effective date of this section.
