  1.1                          A bill for an act 
  1.2             relating to gambling; giving the gambling control 
  1.3             board authority to issue or renew, or not revoke, a 
  1.4             license in certain circumstances; amending Minnesota 
  1.5             Statutes 1994, section 349.155, subdivision 3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 349.155, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  [MANDATORY DISQUALIFICATIONS.] (a) In the case of 
  1.10  licenses for manufacturers, distributors, bingo halls, and 
  1.11  gambling managers, the board may not issue or renew a license 
  1.12  under this chapter, and shall revoke a license under this 
  1.13  chapter, if the applicant or licensee, or a director, officer, 
  1.14  partner, governor, person in a supervisory or management 
  1.15  position of the applicant or licensee, or an employee eligible 
  1.16  to make sales on behalf of the applicant or licensee: 
  1.17     (1) has ever been convicted of a felony or a crime 
  1.18  involving gambling; 
  1.19     (2) has ever been convicted of (i) assault, (ii) a criminal 
  1.20  violation involving the use of a firearm, or (iii) making 
  1.21  terroristic threats; 
  1.22     (3) is or has ever been connected with or engaged in an 
  1.23  illegal business; 
  1.24     (4) owes $500 or more in delinquent taxes as defined in 
  1.25  section 270.72; 
  2.1      (5) had a sales and use tax permit revoked by the 
  2.2   commissioner of revenue within the past two years; or 
  2.3      (6) after demand, has not filed tax returns required by the 
  2.4   commissioner of revenue.  The board may deny or refuse to renew 
  2.5   a license under this chapter, and may revoke a license under 
  2.6   this chapter, if any of the conditions in this paragraph are 
  2.7   applicable to an affiliate or direct or indirect holder of more 
  2.8   than a five percent financial interest in the applicant or 
  2.9   licensee.  
  2.10     (b) In the case of licenses for organizations, the board 
  2.11  may not refuse to issue or renew a license under this chapter, 
  2.12  and shall may revoke a license under this chapter, if the 
  2.13  organization, or an officer or member of the governing body of 
  2.14  the organization:  
  2.15     (1) has been convicted of a felony or gross misdemeanor 
  2.16  within the five years before the issuance or renewal of the 
  2.17  license; 
  2.18     (2) has ever been convicted of a crime involving gambling; 
  2.19  or 
  2.20     (3) has had a license issued by the board or director 
  2.21  permanently revoked for violation of law or board rule.
