  1.1                          A bill for an act 
  1.2             relating to capital improvements; authorizing the 
  1.3             issuance of state bonds; appropriating money for 
  1.4             construction of the Children's Theatre Company 
  1.5             renovation and expansion; authorizing Hennepin county 
  1.6             to undertake a program to provide certain facilities. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [APPROPRIATION; CHILDREN'S THEATRE COMPANY.] 
  1.9      $12,000,000 is appropriated to Hennepin county to 
  1.10  predesign, design, construct, furnish, and equip a renovated and 
  1.11  expanded facility for the Children's Theatre Company, as 
  1.12  provided in this section and section 2, pursuant to Minnesota 
  1.13  Statutes, section 16A.695.  Up to $1,500,000 of this 
  1.14  appropriation is available for predesign and design upon a 
  1.15  demonstration, as determined by Hennepin county, that an equal 
  1.16  amount of nonstate money has been secured for such purposes.  
  1.17  The balance of the appropriation is available upon a 
  1.18  demonstration that sufficient funding, as determined by Hennepin 
  1.19  county, which may include loans, has been secured from nonstate 
  1.20  sources, in the amount of $1 for every $1 of state funds, and a 
  1.21  determination that the total funds available are sufficient to 
  1.22  complete a functional facility.  For purposes of this section, 
  1.23  "nonstate source" means a source other than a direct state 
  1.24  appropriation for this facility.  Funds secured before the date 
  1.25  of enactment are eligible to count toward the required 
  1.26  commitment of nonstate sources provided they are used for 
  2.1   qualified capital expenditures. 
  2.2      Sec. 2.  [PROGRAM AUTHORITY; SUBLEASE.] 
  2.3      Hennepin county may acquire and better facilities for a 
  2.4   public museum, a gallery of art, a school of arts or crafts, an 
  2.5   auditorium, including an auditorium for theatrical performances 
  2.6   primarily for children and youth or for any of said uses or uses 
  2.7   ancillary thereto, and may enter into a leasehold for a term of 
  2.8   not less than 60 years for certain property owned by the 
  2.9   Minneapolis Park and Recreation Board and leased pursuant to 
  2.10  Laws 1911, chapter 95, to the Minneapolis Institute of Arts, on 
  2.11  which to construct and operate such facility, consistent with 
  2.12  section 1.  Hennepin county may sublease the property and 
  2.13  improvements to a nonprofit organization to manage and carry out 
  2.14  a program consistent with the authorizations in the Minneapolis 
  2.15  Park and Recreation Board lease as set forth therein.  The lease 
  2.16  or management agreement must comply with Minnesota Statutes, 
  2.17  section 16A.695. 
  2.18     Sec. 3.  [BOND SALE.] 
  2.19     To provide the money appropriated in this act from the bond 
  2.20  proceeds fund, the commissioner of finance shall sell and issue 
  2.21  bonds of the state in an amount up to $12,000,000 in the manner, 
  2.22  upon the terms, and with the effect prescribed by Minnesota 
  2.23  Statutes, sections 16A.631 to 16A.675, and by the Minnesota 
  2.24  Constitution, article XI, sections 4 to 7. 
  2.25     Sec. 4.  [EFFECTIVE DATE.] 
  2.26     This act is effective the day following final enactment.
