  1.1                          A bill for an act
  1.2             relating to local government; permitting a member of a 
  1.3             city council to vote to fill a vacancy in office in 
  1.4             certain circumstances; amending Minnesota Statutes 
  1.5             1996, section 471.46. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 471.46, is 
  1.8   amended to read: 
  1.9      471.46 [VACANCIES; PERSONS INELIGIBLE TO APPOINTMENT.] 
  1.10     No county, city, town, or school district officer shall be 
  1.11  appointed to fill a vacancy in any elective office if the 
  1.12  officer has the power, either alone or as a member of a board, 
  1.13  to make the appointment; and the ineligibility shall not be 
  1.14  affected by resignation before such appointment is made.  This 
  1.15  section shall not prevent the appointment of a member of a city 
  1.16  council to the office of mayor or clerk, but in that case the 
  1.17  member shall not vote in the appointment.
