  1.1                          A bill for an act 
  1.2             relating to motor vehicles; regulating licensed 
  1.3             dealers; providing an exception; amending Minnesota 
  1.4             Statutes 1996, section 168.27, subdivision 8. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 168.27, 
  1.7   subdivision 8, is amended to read: 
  1.8      Subd. 8.  [EXEMPTIONS.] (1) Salespeople and other employees 
  1.9   of licensed dealers under this section shall not be required to 
  1.10  obtain individual licenses. 
  1.11     (2) Isolated or occasional sales or leases of new or used 
  1.12  motor vehicles shall be exempt from the provisions of this 
  1.13  section.  A person who makes only isolated or occasional sales 
  1.14  or leases is not required to be licensed under this section, is 
  1.15  not considered to be in the business of selling or leasing motor 
  1.16  vehicles, and does not qualify to receive dealer plates under 
  1.17  subdivision 16.  "Isolated or occasional sales or leases" 
  1.18  means:  (i) all sales, purchases, or leases of motor vehicles 
  1.19  made by a nonprofit organization; or (ii) the sale, purchase, or 
  1.20  lease of not more than five motor vehicles in a 12-month period. 
  1.21  by a person other than a nonprofit organization. 
  1.22     For purposes of this subdivision, a nonprofit organization 
  1.23  means an organization whose nonprofit status is evidenced by a 
  1.24  current letter of exemption from the Internal Revenue Service 
  1.25  recognizing it as a nonprofit organization exempt from payment 
  2.1   of income taxes or that is incorporated as a nonprofit 
  2.2   corporation and registered with the secretary of state under 
  2.3   chapter 317A.
