  1.1                          A bill for an act 
  1.2             relating to municipalities; clarifying an exception to 
  1.3             tort liability; amending Minnesota Statutes 1996, 
  1.4             section 466.03, subdivision 4. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 466.03, 
  1.7   subdivision 4, is amended to read: 
  1.8      Subd. 4.  [ACCUMULATIONS OF SNOW AND ICE.] (a) Any claim 
  1.9   based on snow or ice conditions on any highway or public 
  1.10  sidewalk that does not abut a publicly owned building or 
  1.11  publicly owned parking lot, except when the condition is 
  1.12  affirmatively caused by the negligent acts of the municipality. 
  1.13     (b) Notwithstanding paragraph (a), a municipality that owns 
  1.14  or leases a building or parking lot in another municipality is 
  1.15  not immune from a claim based on snow or ice conditions on a 
  1.16  public sidewalk abutting the building or parking lot, but the 
  1.17  other municipality is immune, except when the condition is 
  1.18  affirmatively caused by its own negligent acts.
