A bill for an act
relating to local government; authorizing municipalities to permit certain
solicitations; proposing coding for new law in Minnesota Statutes, chapter 465.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Notwithstanding any law or ordinance to the contrary, a municipality may by
resolution permit full-time permanent firefighters employed by the municipality while
on duty, or volunteer firefighters serving the municipality while not on duty, to solicit
charitable contributions from motorists if the following conditions are met:

new text begin (1) the solicitation is for only one charitable organization annually, and that
charitable organization is qualified under section 501(c)(3) of the Internal Revenue Code
and is registered as a charity under state law;

new text begin (2) the solicitation does not occur for more than three days, whether or not
consecutively, in any calendar year; and

new text begin (3) the charitable organization provides to the municipality proof of commercial
general liability insurance against claims for bodily injury and property damage if the
injury or damage occurs (i) on public streets, roads, or rights-of-way, or (ii) as a result of
the solicitor's activities. The insurance must have a limit of no less than $1,500,000 per
occurrence and an endorsement to the policy naming the municipality as an additional
insured.
