  1.1                          A bill for an act 
  1.2             relating to education; providing for expanded 
  1.3             equalization of safety and health levy; expanding the 
  1.4             use of health and safety revenue to include student 
  1.5             safety; amending Minnesota Statutes 1999 Supplement, 
  1.6             section 123B.57, subdivisions 4 and 6. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1999 Supplement, section 
  1.9   123B.57, subdivision 4, is amended to read: 
  1.10     Subd. 4.  [HEALTH AND SAFETY LEVY.] (a) To receive health 
  1.11  and safety revenue, a district may levy an amount equal to the 
  1.12  district's health and safety revenue up to $100 per adjusted 
  1.13  marginal pupil unit, as defined in subdivision 3 multiplied by 
  1.14  the lesser of one, or the ratio of the quotient derived by 
  1.15  dividing the adjusted net tax capacity of the district for the 
  1.16  year preceding the year the levy is certified by the adjusted 
  1.17  marginal cost pupil units in the district for the school year to 
  1.18  which the levy is attributable, to $3,956 $8,404. 
  1.19     (b) For any remaining health and safety revenue, a district 
  1.20  may levy an amount equal to the district's remaining health and 
  1.21  safety revenue as defined in subdivision 3 multiplied by the 
  1.22  lesser of one, or the ratio of the quotient derived by dividing 
  1.23  the adjusted net tax capacity of the district for the year 
  1.24  preceding the year the levy is certified by the adjusted 
  1.25  marginal cost pupil units in the district for the school year to 
  1.26  which the levy is attributable, to $3,956. 
  2.1      Sec. 2.  Minnesota Statutes 1999 Supplement, section 
  2.2   123B.57, subdivision 6, is amended to read: 
  2.3      Subd. 6.  [Uses of health and safety revenue.] Health and 
  2.4   safety revenue may be used only for approved expenditures 
  2.5   necessary to correct fire safety hazards, life safety hazards, 
  2.6   or for the removal or encapsulation of asbestos from school 
  2.7   buildings or property, asbestos-related repairs, cleanup and 
  2.8   disposal of polychlorinated biphenyls found in school buildings 
  2.9   or property, or the cleanup, removal, disposal, and repairs 
  2.10  related to storing heating fuel or transportation fuels such as 
  2.11  alcohol, gasoline, fuel oil, and special fuel, as defined in 
  2.12  section 296A.01, labor and industry regulated facility and 
  2.13  equipment hazards, and health, safety, and environmental 
  2.14  management, and student safety.  Health and safety revenue must 
  2.15  not be used for the construction of new facilities or the 
  2.16  purchase of portable classrooms.  The revenue may not be used 
  2.17  for a building or property or part of a building or property 
  2.18  used for post-secondary instruction or administration or for a 
  2.19  purpose unrelated to elementary and secondary education.
