  1.1                          A bill for an act 
  1.2             relating to taxation; authorizing cities to establish 
  1.3             water submetering programs and to finance water 
  1.4             programs with revenue obligations; amending Minnesota 
  1.5             Statutes 2002, section 471.342, subdivisions 3, 5, by 
  1.6             adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 471.342, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 2a.  [WATER SUBMETERING.] In this section, "water 
  1.11  submetering" means metering devices in multifamily dwellings and 
  1.12  related services, which detect water leaks and monitor water 
  1.13  usage of specific units or areas. 
  1.14     Sec. 2.  Minnesota Statutes 2002, section 471.342, 
  1.15  subdivision 3, is amended to read: 
  1.16     Subd. 3.  [PROGRAM AUTHORITY.] A city may establish an 
  1.17  inflow and infiltration prevention program and a water 
  1.18  submetering program and provide loans and grants to property 
  1.19  owners to assist the owners in financing the cost of abating 
  1.20  inflow and infiltration and water conservation and leak 
  1.21  detection on their property.  
  1.22     Sec. 3.  Minnesota Statutes 2002, section 471.342, 
  1.23  subdivision 5, is amended to read: 
  1.24     Subd. 5.  [PROGRAM FINANCING.] The city may finance the 
  1.25  program programs with federal, state, private, or city funds.  
  1.26  City funds include, but are not limited to, general fund 
  2.1   appropriations, sanitary or storm sewer utility funds, and fees 
  2.2   or charges.  A city may also issue revenue obligations payable 
  2.3   solely from fees and charges imposed for program costs and loan 
  2.4   repayments to finance the programs. 
  2.5      Sec. 4.  [EFFECTIVE DATE.] 
  2.6      This act is effective the day following final enactment.
