{\rtf1\ansi\deff0{\fonttbl{\f0 Times New Roman;}}\margl480\margr0\margt0\margb0\fs20\n\line \line\n\line \line\n\line \line\n\line {\pard\n\line \n\line \n\line 1.1 A bill for an act \n\line 1.2 relating to natural resources; providing for \n\line 1.3 maintenance of leased property; permitting aquatic \n\line 1.4 plant grants; making certain state park permit \n\line 1.5 exemptions; providing for federal law compliance; \n\line 1.6 modifying certain appropriations; appropriating money; \n\line 1.7 amending Minnesota Statutes 2000, sections 84.153; \n\line 1.8 84.975, by adding a subdivision; 85.054, by adding a \n\line 1.9 subdivision; 97A.055, by adding a subdivision; Laws \n\line 1.10 2001, First Special Session chapter 2, section 5, \n\line 1.11 subdivisions 2, 5, 6, 7, 8, 11; proposing coding for \n\line 1.12 new law in Minnesota Statutes, chapter 97A. \n\line 1.13 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: \n\line 1.14 Section 1. Minnesota Statutes 2000, section 84.153, is \n\line 1.15 amended to read: \n\line 1.16 84.153 [PROPERTY; LEASING, RENTING.] \n\line 1.17 {\ul (a)} The commissioner is hereby authorized at public or \n\line 1.18 private vendue and at such prices and under such terms and \n\line 1.19 conditions as the commissioner may prescribe, to lease any \n\line 1.20 buildings or lands not now authorized to be leased, acquired in \n\line 1.21 the name of the state of Minnesota by any of the several \n\line 1.22 divisions of the department which are not presently needed for \n\line 1.23 the uses and purposes of any of the divisions of the \n\line 1.24 department. The purposes for which such leases may be executed \n\line 1.25 shall be in the furtherance of the interests of conservation and \n\line 1.26 such uses shall not result in any permanent injury to the land. \n\line 1.27 No such lease shall be made for a term to exceed two years and \n\line 1.28 shall contain a provision for cancellation at any time by the \n\line 1.29 commissioner upon three months written notice. All money \n\line 2.1 received from these leases shall be credited to the fund from \n\line 2.2 which the property was acquired{\ul , except an amount equal to the} \n\line 2.3 {\ul cost of maintenance of the leased property shall be credited to} \n\line 2.4 {\ul the fund charged with the cost of maintenance. Money credited} \n\line 2.5 {\ul for leased property maintenance is appropriated to the} \n\line 2.6 {\ul commissioner for that purpose}. \n\line 2.7 {\ul (b)} The commissioner is hereby authorized to rent or lease \n\line 2.8 to employees of the various divisions of the department such \n\line 2.9 cabins, buildings, or living quarters as are now or may \n\line 2.10 hereafter be constructed upon state-owned lands under the \n\line 2.11 control of the several divisions of the department, when this \n\line 2.12 occupancy is found to be necessary or beneficial to the work of \n\line 2.13 the department. These leases or rental agreements shall be upon \n\line 2.14 a month to month basis and provide for surrender by the lessee \n\line 2.15 upon demand at any time the lessee's services with the state may \n\line 2.16 be terminated, without the necessity of any written notice. All \n\line 2.17 receipts from rents shall be paid in to the state treasurer and \n\line 2.18 credited to the fund charged with the cost of maintenance of \n\line 2.19 such buildings and are hereby appropriated for such use. \n\line 2.20 {\ul (c)} All instruments and transactions so negotiated shall be \n\line 2.21 approved as to form, validity, and execution by the attorney \n\line 2.22 general. \n\line 2.23 {\ul (d)} Hunting of wild game is prohibited on any land which \n\line 2.24 has been posted by the lessee to prohibit hunting. Such \n\line 2.25 prohibition shall apply to all persons including the lessee. \n\line 2.26 Sec. 2. Minnesota Statutes 2000, section 84.975, is \n\line 2.27 amended by adding a subdivision to read: \n\line 2.28 {\ul Subd. 4.} [AQUATIC PLANT GRANTS.] {\ul The commissioner may make} \n\line 2.29 {\ul grants for aquatic plant restoration projects, research, and} \n\line 2.30 {\ul propagation.} \n\line 2.31 Sec. 3. Minnesota Statutes 2000, section 85.054, is \n\line 2.32 amended by adding a subdivision to read: \n\line 2.33 {\ul Subd. 9.} [LAKE BEMIDJI STATE PARK.] {\ul A state park permit is} \n\line 2.34 {\ul not required and a fee may not be charged for motor vehicle} \n\line 2.35 {\ul entry to, use of roads to, or parking at the department of} \n\line 2.36 {\ul natural resources regional headquarters portion of Lake Bemidji} \n\line 3.1 {\ul state park.} \n\line 3.2 Sec. 4. Minnesota Statutes 2000, section 97A.055, is \n\line 3.3 amended by adding a subdivision to read: \n\line 3.4 {\ul Subd. 2a.} [FEDERAL AID DISPOSITION.] {\ul (a) Federal aid} \n\line 3.5 {\ul reimbursements under the Federal Aid in Wildlife Restoration} \n\line 3.6 {\ul Act, United States Code, title 16, sections 669 to 669i, shall} \n\line 3.7 {\ul be deposited in the game and fish fund.} \n\line 3.8 {\ul (b) Federal aid reimbursements under the Federal Aid in} \n\line 3.9 {\ul Fish Restoration Act, United States Code, title 16, sections 777} \n\line 3.10 {\ul to 777k, shall be deposited in the game and fish fund.} \n\line 3.11 Sec. 5. [97A.057] [FEDERAL LAW COMPLIANCE; RESTRICTION ON \n\line 3.12 LICENSE REVENUE.] \n\line 3.13 {\ul Subdivision 1.} [COMPLIANCE WITH FEDERAL LAW.] {\ul The} \n\line 3.14 {\ul commissioner shall take any action necessary to comply with the} \n\line 3.15 {\ul Federal Aid in Wildlife Restoration Act, United States Code,} \n\line 3.16 {\ul title 16, sections 669 to 669i, and the Federal Aid in Fish} \n\line 3.17 {\ul Restoration Act, United States Code, title 16, sections 777 to} \n\line 3.18 {\ul 777k.} \n\line 3.19 {\ul Subd. 2.} [RESTRICTION ON LICENSE REVENUE.] {\ul Money accruing} \n\line 3.20 {\ul to the state from fees charged for hunting and angling licenses} \n\line 3.21 {\ul shall not be used for any purpose other than game and fish} \n\line 3.22 {\ul activities and related activities under the administration of} \n\line 3.23 {\ul the commissioner.} \n\line 3.24 Sec. 6. The \n\line 4.40 portion of this appropriation allocated \n\line 4.41 to the Minneapolis park and recreation \n\line 4.42 board includes money for the Bassett's \n\line 4.43 Creek trail to connect the Cedar Lake \n\line 4.44 trail and the Luce Line trail. \n\line 4.45 $247,000 the first year and $253,000 \n\line 4.46 the second year are for state forest \n\line 4.47 campground operations. \n\line 4.48 $4,103,000 the first year and \n\line 4.49 $4,453,000 the second year are from the \n\line 4.50 natural resources fund for state park \n\line 4.51 and recreation area operations and \n\line 4.52 acquisition. This appropriation is \n\line 4.53 from the revenue deposited to the \n\line 4.54 natural resources fund under Minnesota \n\line 4.55 Statutes, section 297A.94, paragraph \n\line 4.56 (e), clause (2). Of this amount: \n\line 5.1 (1) $1,805,000 the first year and \n\line 5.2 $1,805,000 the second year are to \n\line 5.3 restore camping and day use in state \n\line 5.4 parks, make camping available in the \n\line 5.5 spring and fall, provide maintenance to \n\line 5.6 the facilities and security for park \n\line 5.7 visitors, and partially fund winter \n\line 5.8 operations; \n\line 5.9 (2) $280,000 the first year and \n\line 5.10 $290,000 the second year are to fund \n\line 5.11 state park emergency maintenance \n\line 5.12 projects; \n\line 5.13 (3) $413,000 the first year and \n\line 5.14 $413,000 the second year are to fund \n\line 5.15 state park resource management \n\line 5.16 activities; \n\line 5.17 (4) $185,000 the first year is to fund \n\line 5.18 the purchase of the campground \n\line 5.19 manager/point-of-sale system for 28 \n\line 5.20 state parks; \n\line 5.21 (5) $100,000 the first year and \n\line 5.22 $100,000 the second year are to make \n\line 5.23 improvements to the state park Web site \n\line 5.24 and provide additional state park \n\line 5.25 informational brochures and more state \n\line 5.26 park maps; \n\line 5.27 (6) $50,000 the first year and $50,000 \n\line 5.28 the second year are to replace \n\line 5.29 computers in the field and regional \n\line 5.30 office locations according to \n\line 5.31 department standards; \n\line 5.32 (7) $75,000 the first year is to \n\line 5.33 complete master plans for both Big Bog \n\line 5.34 and Red River state recreation areas; \n\line 5.35 (8) {\strike $600,000} {\ul $200,000} the second year \n\line 5.36 is for operating costs, including \n\line 5.37 fisheries management, of the Red River \n\line 5.38 state recreation area; \n\line 5.39 (9) $200,000 the first year \n\line 5.40 and {\strike $200,000} {\ul $100,000} the second year \n\line 5.41 are for operating costs of the Big Bog \n\line 5.42 state recreation area; {\strike and} \n\line 5.43 (10) $995,000 the first year {\strike and} \n\line 5.44 {\strike $995,000 the second year are} {\ul is} for \n\line 5.45 acquisition of in-holdings for state \n\line 5.46 parks and recreation areas{\ul ; and} \n\line 5.47 {\ul (11) $1,495,000 the second year is for} \n\line 5.48 {\ul state park operations}. \n\line 5.49 The appropriations in clauses (2) to \n\line 5.50 {\strike (10)} {\ul (11)} are one-time appropriations. \n\line 5.51 $4,130,000 the first year and \n\line 5.52 $5,130,000 the second year are from the \n\line 5.53 natural resources fund for a grant to \n\line 5.54 the metropolitan council for \n\line 5.55 metropolitan area regional parks and \n\line 5.56 trails maintenance and operations. \n\line 5.57 This appropriation is from the revenue \n\line 5.58 deposited to the natural resources fund \n\line 5.59 under Minnesota Statutes, section \n\line 6.1 297A.94, paragraph (e), clause \n\line 6.2 (3). {\ul The appropriation in the first} \n\line 6.3 {\ul year is available in the second year.} \n\line 6.4 {\ul Notwithstanding Minnesota Statutes,} \n\line 6.5 {\ul section 16A.28, amounts encumbered} \n\line 6.6 {\ul under contract on or before June 30,} \n\line 6.7 {\ul 2003, are available until June 30, 2004.}\n\line 6.8 $1,000,000 the first year is from the \n\line 6.9 natural resources fund for a grant to \n\line 6.10 the city of St. Paul to restore East \n\line 6.11 Como Lake trail and lakeshore in Como \n\line 6.12 Park. The money is available until \n\line 6.13 expended. This is a one-time \n\line 7.42 appropriation. \n\line 7.43 $150,000 the first year is from the \n\line 7.44 water recreation account in the natural \n\line 7.45 resources fund for necessary \n\line 7.46 improvements and repairs at the Knife \n\line 7.47 river harbor of refuge and marina. \n\line 7.48 This appropriation is available until \n\line 7.49 spent. \n\line 7.50 $100,000 the first year is from the \n\line 7.51 water recreation account in the natural \n\line 7.52 resources fund for an inventory of the \n\line 7.53 Red River of the North, to make \n\line 7.54 recommendations to the legislature on \n\line 7.55 the cost of improvements necessary for \n\line 7.56 the canoe and boating route on the \n\line 7.57 river, and for mapping and signing the \n\line 7.58 lower portion of the river from \n\line 7.59 Breckenridge to Georgetown. \n\line 7.60 [EFFECTIVE DATE.] {\ul This section is effective the day} \n\line 7.61 {\ul following final enactment.} \n\line 7.62 Sec. 9.
