  1.1                          A bill for an act
  1.2             relating to emergency management; creating a fund for 
  1.3             disaster relief for individuals and families; 
  1.4             appropriating money; amending Minnesota Statutes 1994, 
  1.5             section 9.061, subdivision 1; proposing coding for new 
  1.6             law in Minnesota Statutes, chapter 299A. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 9.061, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [PREVENTION AND RELIEF; COMMANDEERING 
  1.11  PROPERTY.] The executive council may: 
  1.12     (a) take such measures as are necessary to prevent an 
  1.13  impending disaster that threatens to destroy life or property; 
  1.14     (b) grant relief to communities stricken by disease, fire, 
  1.15  action of the elements, or extreme economic distress; 
  1.16     (c) prevent the occurrence or spread of any disaster; and 
  1.17     (d) grant relief to individuals or families adversely 
  1.18  affected by a major disaster in conformance with federal 
  1.19  disaster relief laws and regulations and award additional relief 
  1.20  from the Minnesota disaster relief fund under section 299A.65.  
  1.21  Any grants made shall be refunded to the state if the financial 
  1.22  assistance needed is received from any other source; and 
  1.23     (e) repair state property damaged by a major disaster in 
  1.24  conformance with federal disaster relief laws and regulations.  
  1.25     In these emergencies, the executive council may, when 
  1.26  necessary, commandeer and use any property, vehicle, means of 
  2.1   transportation, means of communication, or public service.  The 
  2.2   owner of any property taken shall be given a receipt for the 
  2.3   property and be paid for its use and for any damages inflicted 
  2.4   upon the property while in the service of the executive council. 
  2.5      Sec. 2.  [299A.65] [MINNESOTA DISASTER RELIEF FUND.] 
  2.6      The commissioner of the department of public safety shall 
  2.7   administer the Minnesota disaster relief fund.  The purpose of 
  2.8   the fund is for grants to individuals and families adversely 
  2.9   affected by a major disaster.  The executive council shall 
  2.10  determine the dollar amount of each grant.  Grants may be 
  2.11  awarded for disasters that did not receive federal disaster 
  2.12  relief award. 
  2.13     Sec. 3.  [APPROPRIATION.] 
  2.14     $....... is appropriated from the general fund to the 
  2.15  commissioner of public safety for the establishment of the 
  2.16  Minnesota disaster relief fund.
