  1.1                          A bill for an act 
  1.2             relating to insurance; homeowners; regulating claim 
  1.3             denials; proposing coding for new law in Minnesota 
  1.4             Statutes, chapter 65A. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [65A.296] [LOSS OF USE; CLAIMS DENIALS.] 
  1.7      If an insurer denies a homeowner's insurance claim based on 
  1.8   a loss that makes the dwelling not fit to live in and the 
  1.9   insured has begun a civil action to contest the claim denial, 
  1.10  the insurer must, during the pendency of the civil action, pay 
  1.11  the insured the amounts that the insured would have been 
  1.12  entitled to under the policy for loss of use had the claim not 
  1.13  been denied. 
  1.14     If the denial is upheld by the court, or upon agreement of 
  1.15  the parties, the insurer may recover from the insured all 
  1.16  payments made according to this section. 
  1.17     For the purposes of this section, the terms "homeowner's 
  1.18  insurance" and "insurer" have the meanings given them in section 
  1.19  65A.27.
