  1.1                          A bill for an act 
  1.2             relating to state lands; authorizing the conveyance of 
  1.3             certain surplus state land in Anoka county. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [CONVEYANCE OF STATE LAND; ANOKA COUNTY.] 
  1.6      Subdivision 1.  [CONVEYANCE AUTHORIZED.] Notwithstanding 
  1.7   Minnesota Statutes, sections 92.45, 94.09, 94.10, and 103F.335, 
  1.8   subdivision 3, or any other law to the contrary, the 
  1.9   commissioner of administration shall convey the land described 
  1.10  in subdivision 3 to Anoka county. 
  1.11     Subd. 2.  [FORM.] (a) The conveyance shall be in a form 
  1.12  approved by the attorney general. 
  1.13     (b) The conveyance is subject to a scenic easement, as 
  1.14  defined in Minnesota Statutes, section 103F.311, subdivision 6, 
  1.15  to be under the custodial control of the commissioner of natural 
  1.16  resources, on that portion of the conveyed land that is 
  1.17  designated for inclusion in the wild and scenic river system 
  1.18  under Minnesota Statutes, section 103F.325.  The scenic easement 
  1.19  shall allow for continued use of the structures located within 
  1.20  the easement and for development of a walking path within the 
  1.21  easement. 
  1.22     (c) The conveyance shall restrict use of the land to 
  1.23  governmental, including recreational, purposes and shall provide 
  1.24  that ownership of any portion of the land that ceases to be used 
  2.1   for such purposes shall revert to the state of Minnesota. 
  2.2      (d) The commissioner of administration shall convey the 
  2.3   property by quit claim deed to Anoka county within 30 days 
  2.4   following the date that execution and recording of the scenic 
  2.5   easement under paragraph (b) has been completed. 
  2.6      (e) Notwithstanding any law, regulation, or ordinance to 
  2.7   the contrary, the instrument of conveyance to Anoka county may 
  2.8   be recorded in the office of the Anoka county recorder without 
  2.9   compliance with any subdivision requirement. 
  2.10     Subd. 3.  [LAND DESCRIPTION.] Subject to right-of-way for 
  2.11  Grant Street, Northview Lane, Garfield Street, 5th Avenue, and 
  2.12  State Trunk Highway No. 288, also known as 4th Avenue, the land 
  2.13  to be conveyed is described as follows: 
  2.14     (1) all that part of Government Lots 3 and 4 and that part 
  2.15  of the Southeast Quarter of the Southwest Quarter, all in 
  2.16  Section 31, Township 32 North, Range 24 West, Anoka county, 
  2.17  Minnesota, described as follows: 
  2.18     Beginning at the southwest corner of said Southeast Quarter 
  2.19     of the Southwest Quarter of Section 31; thence North 13 
  2.20     degrees 16 minutes 11 seconds East, assumed bearing, 473.34 
  2.21     feet; thence North 07 degrees 54 minutes 43 seconds East 
  2.22     186.87 feet; thence North 14 degrees 08 minutes 33 seconds 
  2.23     West 154.77 feet; thence North 62 degrees 46 minutes 44 
  2.24     seconds West 526.92 feet; thence North 25 degrees 45 
  2.25     minutes 30 seconds East 74.43 feet; thence northerly 88.30 
  2.26     feet along a tangential curve concave to the west having a 
  2.27     radius of 186.15 feet and a central angle of 27 degrees 10 
  2.28     minutes 50 seconds; thence North 01 degrees 25 minutes 20 
  2.29     seconds West, tangent to said curve, 140.53 feet; thence 
  2.30     North 71 degrees 56 minutes 34 seconds West to the 
  2.31     southeasterly shoreline of the Rum river; thence 
  2.32     southwesterly along said shoreline to the south line of 
  2.33     said Government Lot 4; thence easterly along said south 
  2.34     line to the point of beginning.  For the purpose of this 
  2.35     description the south line of said Southeast Quarter of the 
  2.36     Southwest Quarter of Section 31 has an assumed bearing of 
  3.1      North 89 degrees 08 minutes 19 seconds East; 
  3.2      (2) Government Lot 1, Section 6, Township 31 North, Range 
  3.3   24 West, Anoka county, Minnesota; EXCEPT that part platted as 
  3.4   Grant Properties, Anoka county, Minnesota; ALSO EXCEPT that part 
  3.5   lying southerly of the westerly extension of the south line of 
  3.6   Block 6, Woodbury's Addition to the city of Anoka, Anoka county, 
  3.7   Minnesota, and lying westerly of the west line of said plat of 
  3.8   Grant Properties, said line also being the centerline of 4th 
  3.9   Avenue; 
  3.10     (3) all that part of said Block 6, Woodbury's Addition to 
  3.11  the city of Anoka lying westerly of Northview 1st Addition, 
  3.12  Anoka county, Minnesota; 
  3.13     (4) all that part of said Northview 1st Addition lying 
  3.14  westerly of the east line of Lots 11 through 20, Block 1, 
  3.15  inclusive, thereof; and 
  3.16     (5) all that part of the Northeast Quarter of the Northwest 
  3.17  Quarter of said Section 6, Township 31 North, Range 24 West, 
  3.18  Anoka county, Minnesota, lying northerly of the centerline of 
  3.19  Grant Street as defined by said plat of Grant Properties and 
  3.20  lying westerly of said east line of Lots 11 through 20, Block 1, 
  3.21  inclusive, Northview 1st Addition and said line's extension 
  3.22  north and south. 
  3.23     Subd. 4.  [DETERMINATION.] The commissioner of human 
  3.24  services has determined that the land described in subdivision 3 
  3.25  will no longer be needed for the Anoka metro regional treatment 
  3.26  center upon completion of new state facilities.  The state's 
  3.27  land management interests would best be served by conveying the 
  3.28  land to Anoka county for governmental, including recreational, 
  3.29  use.
