A bill for an act
relating to human services; providing a nursing facility rate increase for a
specified facility; amending Minnesota Statutes 2010, section 256B.441, by
adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 256B.441, is amended by adding a
subdivision to read:

new text begin Rate increase for nursing facility in Ramsey County. new text end

new text begin If licensed beds
are transferred to a nursing facility located in Ramsey County that is currently licensed
for 40 beds and the facility elects to participate in the medical assistance program, the
commissioner shall determine operating payment rates according to the principles in
Minnesota Rules, part 9549.0057, and the definitions and rate calculations in this section.
Notwithstanding section 256B.431, subdivision 27, paragraph (i), rate calculations are
subject to limits as prescribed in rule and law. Other than the adjustments in sections
256B.431, subdivisions 30 and 32; 256B.437, subdivision 3, paragraph (b); Minnesota
Rules, part 9549.0057; and any other applicable legislation enacted prior to the finalization
of operating payment rates, facilities assuming full participation in medical assistance
under this subdivision are not eligible for any rate adjustments until the October 1
following their settle-up period.
