A bill for an act
relating to human services; modifying ICF/MR variable payment rates;
appropriating money; amending Minnesota Statutes 2009 Supplement, section
256B.5012, subdivision 8.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2009 Supplement, section 256B.5012, subdivision 8,
is amended to read:


Subd. 8.

ICF/MR rate decreases effective July 1, 2009.

Effective July 1, 2009,
the commissioner shall decrease each facility reimbursed under this section operating
payment adjustments equal to 2.58 percent of the operating payment rates in effect on
June 30, 2009. For each facility, the commissioner shall implement the rate reduction,
based on occupied beds, using the percentage specified in this subdivision multiplied by
the total payment rate, deleted text begin including the variable rate butdeleted text end excludingnew text begin the variable rate andnew text end the
property-related payment rate, in effect on the preceding date. The total rate reduction
