A bill for an act
relating to insurance; allowing TRICARE enrollees to elect not to include medical
expense benefits in the enrollee's automobile insurance policy; amending Minnesota
Statutes 2022, section 65B.44, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 65B.44, is amended by adding a subdivision
to read:

new text begin A plan of reparation security issued to or renewed with a person
who is enrolled in TRICARE must provide medical expense benefits under subdivision 2
unless the insured elects to decline coverage. An election by the insured to decline medical
expense benefits coverage remains in effect until revoked by the insured or until the insured
disenrolls from TRICARE. The reparation obligor must notify a person of the person's rights
under this subdivision at the time of sale and at least once annually after the time of sale.
The rate for any plan for which coverage has been excluded pursuant to this subdivision
must be reduced accordingly. This subdivision applies when the insured has minor dependents
who are not enrolled in TRICARE. This subdivision does not apply to self insurance.
