  1.1                          A bill for an act 
  1.2             relating to telecommunications; providing for 
  1.3             statewide extended area telephone service; proposing 
  1.4             coding for new law in Minnesota Statutes, chapter 237. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [237.664] [STATEWIDE EXTENDED AREA TELEPHONE 
  1.7   SERVICE.] 
  1.8      Subdivision 1.  [INTRASTATE TOLL PROHIBITED.] (a) 
  1.9   Notwithstanding any law, rule, or order to the contrary, no 
  1.10  provider of telephone service may charge a toll for telephone 
  1.11  calls originating and terminating within the state after June 
  1.12  30, 2001.  However, local exchange carriers may continue to 
  1.13  charge long distance telephone service providers for access to 
  1.14  local exchange networks for long distance telephone calls.  For 
  1.15  purposes of this section, telephone calls that both originate 
  1.16  and terminate within the state are not long distance telephone 
  1.17  calls.  
  1.18     (b) After June 30, 2001, a provider of telephone service is 
  1.19  prohibited from charging discriminatory rates for telephone 
  1.20  calls that both originate and terminate within the state.  The 
  1.21  rate charged by a provider for basic telephone service for 
  1.22  customers within its service area must be uniform among its 
  1.23  residential customers. 
  1.24     Subd. 2.  [LOCAL CHARGES.] By June 30, 2001, the public 
  1.25  utilities commission shall determine what local telephone rate 
  2.1   each telephone company, independent telephone company, or long 
  2.2   distance telephone service provider in Minnesota may charge for 
  2.3   telephone calls originating from any local exchange service 
  2.4   area, but the commission shall not allow a rate to be levied 
  2.5   based in whole or in part on the telephone call's place of 
  2.6   termination as long as that place is within the state.
