  1.1                          A bill for an act 
  1.2             relating to retirement; modifying provisions exempting 
  1.3             certain interim superintendents from certain earnings 
  1.4             limitations and reductions in annuity payments; 
  1.5             amending Minnesota Statutes 1996, section 354.44, 
  1.6             subdivision 5a. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 354.44, 
  1.9   subdivision 5a, is amended to read: 
  1.10     Subd. 5a.  [EXEMPTION FOR INTERIM SUPERINTENDENT.] A person 
  1.11  who performs services as an interim superintendent because of 
  1.12  the death, disability, termination, or resignation of the 
  1.13  previous superintendent is exempt from the earnings limitations 
  1.14  and reductions in annuity payments in subdivision 5 for up to 90 
  1.15  120 working days of service as an interim superintendent.  
  1.16  During this period of up to 90 120 working days, the school 
  1.17  board may pay the interim superintendent at any rate, up to the 
  1.18  rate paid to the previous superintendent.  This exemption 
  1.19  applies only if the school board hiring the interim 
  1.20  superintendent submits an application for the exemption on a 
  1.21  form prescribed by the executive director, and the executive 
  1.22  director approves the application before the services as interim 
  1.23  superintendent begin.  The application must certify that the 
  1.24  school board has unanimously approved the exemption from the 
  1.25  earnings limitations and reductions.  The executive director may 
  1.26  prescribe a form for the application.  A school board shall not 
  2.1   apply for more than one exemption in a fiscal year.  No more 
  2.2   than three five exemptions may be approved for any person.  Only 
  2.3   one exemption may be approved for any person in a fiscal year.  
  2.4   The exemption under this subdivision does not apply to a person 
  2.5   who retires from a school district and within one year after 
  2.6   retirement returns to the same school district as an interim 
  2.7   superintendent. 
  2.8      Sec. 2.  [EFFECTIVE DATE.] 
  2.9      Section 1 is effective the day following final enactment.
