A bill for an act
 relating to human services; modifying a nursing facility rate provision; amending
Minnesota Statutes 2008, section 256B.431, subdivision 35.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 256B.431, subdivision 35, is amended to
read:


Subd. 35.

Exclusion of raw food cost adjustment.

For rate years beginning on
or after July 1, 2001, in calculating a nursing facility's operating cost per diem for the
purposes of deleted text begin constructingdeleted text end new text begin comparing tonew text end an array, deleted text begin determiningdeleted text end a median, or deleted text begin otherwise
performing adeleted text end new text begin othernew text end statistical measure of nursing facility payment rates to be used to
determine future rate deleted text begin increasesdeleted text end new text begin adjustments new text end under this section, section 256B.434, or any
other section, the commissioner shall exclude adjustments for raw food costs under
subdivision 2b, paragraph (h), that are related to providing special diets based on religious
beliefs.
