1.1A bill for an act
1.2relating to capital investment; authorizing spending to acquire and better public
1.3land and buildings and other improvements of a capital nature; authorizing the
1.4issuance of state bonds; appropriating money for public safety capital projects.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. CAPITAL IMPROVEMENT APPROPRIATIONS.
1.7    The sums shown in the column under "Appropriations" are appropriated from the
1.8bond proceeds fund, or another named fund, to the state agencies or officials indicated,
1.9to be spent for public purposes. Appropriations of bond proceeds must be spent as
1.10authorized by the Minnesota Constitution, article XI, section 5, paragraph (a), to acquire
1.11and better public land and buildings and other public improvements of a capital nature, or
1.12as authorized by the Minnesota Constitution, article XI, section 5, paragraphs (b) to (j), or
1.13article XIV. Unless otherwise specified, the appropriations in this act are available until
1.14the project is completed or abandoned subject to Minnesota Statutes, section 16A.642.

1.15    Sec. 2. PRIORITIES.
1.16    Subdivision 1. General. The Public Safety Finance Division of the House Finance
1.17Committee prioritizes the appropriations in this act as provided in this section.
1.18    Subd. 2. High priorities. The division finds the following projects as most
1.19deserving of funding:
1.20    Minnesota Correctional Facility - Faribault: Phase III Expansion;
1.21    Department of Corrections: Asset Preservation;
1.22    Public Safety Training Center - Camp Ripley; and
1.23    Southeastern Minnesota Regional Public Safety Training Center - Rochester.
2.1    Subd. 3. Ranking of additional public safety projects. To the extent funds are
2.2available, the division recommends funding the following projects in the order listed
2.3below:
2.4    (1) Minnesota Correctional Facility - Red Wing: Vocational Education Building;
2.5    (2) Public Safety Technology and Support Center - Dakota County;
2.6    (3) Public Safety Training Center - Scott County;
2.7    (4) Emergency Training Center - Gonvick;
2.8    (5) Emergency Operations Center - Minneapolis;
2.9    (6) Tactical Training Center - Annandale;
2.10    (7) Northern Minnesota Regional Training Center - Grand Rapids;
2.11    (8) Minnesota Emergency Response and Industrial Training (MERIT) Regional
2.12Training Center - Marshall;
2.13    (9) Public Safety and Regional Emergency Operations Center - Northfield;
2.14    (10) Forensic Crime Lab - Anoka County;
2.15    (11) Forensic Crime Lab - Minneapolis; and
2.16    (12) Joint Public Safety Building - Princeton.
2.17    Subd. 4. No Recommendation. The division makes no recommendation on the
2.18following project:
2.19    Minnesota Correctional Facility - Shakopee: Perimeter Security Fence.

3.1Faribault facility to deal with the increasing
3.2male offender population. It includes an
3.3intake/receiving/warehouse/watch security
3.4center building and demolition of two
3.5housing units.

3.27management training and exercise center at
3.28Camp Ripley, which includes a classroom
3.29facility and several facilities for field
3.30response training.
3.31Nonmilitary public safety personnel from
3.32Minnesota must be given priority access to
3.33the training facilities. Any fees charged to
3.34nonmilitary public safety personnel from
4.1Minnesota or their employers may not
4.2exceed the fees charged to military personnel
4.3and units that use the facilities.

Subd. 3.Southeastern Minnesota Regional
Public Safety Training Center - Olmsted
County

4.7To the commissioner of public safety
4.8for a grant to Olmsted County to design,
4.9construct, furnish, and equip the Southeastern
4.10Minnesota Regional Public Safety Training
4.11Center in Olmsted County. The facility
4.12must include a live burn training simulator
4.13adjacent to the existing National Guard
4.14facility, a driving range, and a weapons
4.15training facility.
4.16This appropriation is not available until the
4.17commissioner has determined that at least
4.18an equal amount has been committed to the
4.19project from nonstate sources.

Center - Dakota County

4.23grant to Dakota County to design, construct,
4.24furnish, and equip a countywide public
4.25safety technology and support center. This

4.27commissioner of finance determines that at
4.28least an equal amount is committed to the
4.29project from nonstate sources.

County

4.34construction of a regional public safety

5.4public safety professionals, within a 30-mile
5.5radius of the grounds of the public safety
5.6training center.

and Industrial Training (MERIT) Regional
Training Center - Marshall

6.7grant to the city of Marshall to predesign,
6.8design, construct, furnish, and equip Phase II
6.9of the Minnesota Emergency Response and
6.10Industry Training (MERIT) Center, including
6.11a wind energy training area, an ethanol fuels
6.12training area, a multi-use single-story office,
6.13a classroom and simulator building, and
6.14other training facilities.

Emergency Operations Center - Northfield

6.17To the commissioner of public safety for
6.18a grant to the city of Northfield to acquire
6.19land for and to predesign, design, construct,
6.20furnish, and equip a public safety and
6.21regional emergency operations center. This
6.22appropriation is not available until the
6.23commissioner of finance has determined that
6.24at least $3,960,000 has been committed to
6.25the project from nonstate funds.

Subd. 12.Forensic Crime Lab - Anoka County

6.27To the commissioner of public safety for a
6.28grant to Anoka County to design, construct,
6.29furnish, and equip a regional forensic crime
6.30laboratory, for the use of Anoka, Sherburne,
6.31and Wright Counties, to be located in Anoka
6.32County. This appropriation is contingent on
6.33a three-to-one local match.
7.1Anoka County may not hire scientists who
7.2are working for the Bureau of Criminal
7.3Apprehension to staff the county's crime lab.

Subd. 13.Forensic Crime Lab - Minneapolis

7.5To the commissioner of public safety for a
7.6grant to the city of Minneapolis to acquire
7.7land for, predesign, and design a forensic
7.8crime laboratory in Minneapolis. The city
7.9of Minneapolis may not hire scientists who
7.10are working for the Bureau of Criminal
7.11Apprehension to staff the crime lab of the
7.12city of Minneapolis.

Subd. 14.Joint Public Safety Building -
Princeton

7.15To the commissioner of public safety for
7.16a grant to the city of Princeton to design,
7.17construct, furnish, and equip a regional
7.18public safety facility in Princeton.

Subd. 15.Crime Labs Strategic Plan
7.20The commissioner of public safety must
7.21develop a long-term strategic plan for
7.22maintenance and staffing of existing state
7.23and regional crime labs and creation,
7.24maintenance, and staffing of new regional
7.25and local crime labs. The strategic plan must
7.26include, but is not limited to, the following:
7.27(1) an assessment and explanation of the
7.28state's crime lab needs, including the need
7.29for additional regional or local crime labs;
7.30(2) specific recommendations for additional
7.31regional or local crime labs, including
7.32recommendations for locations for new
7.33labs, and a ranking of the specific regions,
8.1counties, or cities that need a crime lab in
8.2order of urgency;
8.3(3) a long-range plan for the training of
8.4state crime lab employees, including the
8.5possibility of sharing employee training costs
8.6with users of the state lab or entities that
8.7operate regional or local labs;
8.8(4) a long-range funding plan for the state
8.9crime lab and state owned regional labs;
8.10(5) an assessment of the state crime lab's
8.11response times and specific recommendations
8.12for improving the lab's response time; and
8.13(6) specific, clearly stated steps for
8.14implementing the strategic plan.
8.15The commissioner must submit the strategic
8.16plan, as a recommendation, to the house of
8.17representatives and senate committees with
8.18responsibility for public safety finance by
8.19February 1, 2009.

8.20    Sec. 5. BOND SALE AUTHORIZATION.
8.21    To provide the money appropriated in this act from the bond proceeds fund, the
8.22commissioner of finance shall sell and issue bonds of the state in an amount up to
8.23$86,036,000 in the manner, upon the terms, and with the effect prescribed by Minnesota
8.24Statutes, sections 16A.631 to 16A.675, and by the Minnesota Constitution, article XI,
8.25sections 4 to 7.

8.26    Sec. 6. EFFECTIVE DATE.
8.27    Except as otherwise provided, this act is effective the day following final enactment.
