A bill for an act
relating to elections; awarding two electoral votes to the presidential candidate
with the highest nationwide vote total; amending Minnesota Statutes 2006,
sections 208.02; 208.05.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2006, section 208.02, is amended to read:
Presidential electors shall be chosen at the deleted text begin statedeleted text end general election held in the year
preceding the expiration of the term of the president of the United States.
Minnesota Statutes 2006, section 208.05, is amended to read:
The State Canvassing Board at its
meeting on the second Tuesday after each state general election shall open and canvass
the returns made to the secretary of state for presidential electors and alternates, new text begin and
new text end prepare a statement of the number of votes cast for the persons receiving votes for these
officesdeleted text begin , and declare the person or persons receiving the highest number of votes for each
office duly electeddeleted text end .

The board shall appoint two electors of the party
whose presidential candidate received the highest number of popular votes combined from
all states and the District of Columbia. The remaining elector offices shall be filled by
the person or persons receiving the highest statewide vote total, as certified by the board.
The governor shall transmit to each selected elector a certificate of election, signed by the
governor, sealed with the state seal, and countersigned by the secretary of state.

When it appears that more than the number of
persons to be elected as presidential electors or alternates have the highest and an equal
number of votes, the secretary of state, in the presence of the board shall decide by lot
which of the persons shall be declared elected. deleted text begin The governor shall transmit to each person

and countersigned by the secretary of state.
