A bill for an act
relating to data practices; requiring state agencies to maintain and publicize a log
of data requests received; amending Minnesota Statutes 2016, section 13.025, by
adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 13.025, is amended by adding a subdivision
to read:

new text begin (a) This subdivision only applies to a state agency or a
statewide system common to one or more state agencies. This subdivision does not apply
to a political subdivision or a statewide system that does not include a state agency.

new text begin (b) The responsible authority shall compile a log of all data requests received in writing
by the government entity. The responsible authority must update the log at least quarterly.

new text begin (c) The log shall include all data requests received in writing. The log shall only include
requests for public data made under section 13.03, and shall not include requests made by
data subjects under section 13.04. The log shall not include identifying information about
the requesting person.

new text begin (d) For each data request listed in the log, the log shall include:

new text begin (1) the date the government entity received the request;
new text end

new text begin (2) a description of the data requested;
new text end

new text begin (3) whether the government entity has complied with the request;
new text end

new text begin (4) the date that the government entity complied with the request, if applicable; and
new text end

new text begin (5) if the government entity has denied the requesting person access to requested data,
the statutory citation on which the denial is based as required under section 13.03, subdivision
3, paragraph (f).

new text begin (e) A copy of the log shall be made easily available to the public by posting it in a
conspicuous location on the government entity's Web site.
