  1.1                          A bill for an act
  1.2             relating to local government; providing for creation 
  1.3             of an advisory council on intergovernmental relations; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 15. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [15.93] [INDEPENDENT ADVISORY COUNCIL ON 
  1.8   INTERGOVERNMENTAL RELATIONS.] 
  1.9      Subdivision 1.  [MEMBERSHIP.] (a) The independent advisory 
  1.10  council on intergovernmental relations may be constituted as a 
  1.11  nonprofit entity by the associations of local governmental 
  1.12  entities listed in paragraph (b).  All members serve at the 
  1.13  pleasure of the appointing authority under paragraphs (b), (c), 
  1.14  and (d). 
  1.15     (b) The council, if constituted under paragraph (a), 
  1.16  includes eight representatives of local government.  Unless 
  1.17  otherwise provided under this paragraph, there must be two 
  1.18  representatives each of cities, counties, townships, and school 
  1.19  districts.  The membership from each type of local government 
  1.20  unit must be geographically balanced.  The representatives shall 
  1.21  be selected by associations representing the respective units of 
  1.22  local government.  If associations are unable to agree on a 
  1.23  representative, the governor shall appoint one.  If an issue 
  1.24  that the council considers does not affect one type of local 
  1.25  government, the representative of that type of government may 
  2.1   withdraw from participation on that issue, and the remaining 
  2.2   members of the council may provide for an additional 
  2.3   representative of another type of local government. 
  2.4      (c) The council, if constituted under paragraph (a), 
  2.5   includes four representatives designated by the governor, 
  2.6   including a representative of the department of finance and a 
  2.7   representative of the department of revenue. 
  2.8      (d) The council, if constituted under paragraph (a), 
  2.9   includes four legislators:  one member of the house of 
  2.10  representatives appointed by the speaker, one senator appointed 
  2.11  by the committee on rules and administration, one member of the 
  2.12  house of representatives appointed by the house minority leader, 
  2.13  and one member of the senate appointed by the senate minority 
  2.14  leader.  The appointing authorities may designate different 
  2.15  legislators to participate in council deliberations on different 
  2.16  issues. 
  2.17     Subd. 2.  [TASK FORCES.] The council may create task forces 
  2.18  to work on specific issues.  Task forces may include people who 
  2.19  are not members of the council. 
  2.20     Subd. 3.  [DUTIES.] The mission of the council, if 
  2.21  constituted, is to discuss and make recommendations to the 
  2.22  legislature and the executive on areas of mutual concern to 
  2.23  state and local government.  The council shall decide the 
  2.24  particular issues that it will address.  These issues may 
  2.25  include, but are not limited to: 
  2.26     (1) state mandates to units of local government; 
  2.27     (2) allocation of responsibilities and funding between 
  2.28  state and local government; 
  2.29     (3) allocation of responsibilities and funding among units 
  2.30  of local government; 
  2.31     (4) opportunities for consolidation of services between 
  2.32  state and local government and among units of local government. 
  2.33     In carrying out these duties, the council shall consult 
  2.34  with and may designate as a special task force, the subcommittee 
  2.35  of the legislative commission on planning and fiscal policy or 
  2.36  its successor entity created in Laws 1995, chapter 264, article 
  3.1   8, section 22. 
  3.2      Subd. 4.  [ADMINISTRATION.] (a) The council shall select a 
  3.3   chair or co-chairs from among the members appointed under 
  3.4   subdivision 1, paragraph (b).  The council may decide to have 
  3.5   the chair or co-chairs rotate among members. 
  3.6      (b) The board on government innovation and cooperation is 
  3.7   authorized to provide administrative services to the council. 
  3.8      (c) The council may accept gifts and grants.  The council 
  3.9   is encouraged to seek gifts, grants, and donations of services 
  3.10  from entities represented on the council. 
  3.11     (d) The council may seek assistance from the board on 
  3.12  government innovation and cooperation, the metropolitan council, 
  3.13  or other entities. 
  3.14     Subd. 5.  [EXPIRATION.] If constituted, the council expires 
  3.15  June 30, 1998. 
  3.16     Sec. 2.  [TEMPORARY.] 
  3.17     The council, if constituted, may initially consider issues 
  3.18  arising from the shift of responsibilities from federal to state 
  3.19  and local government, and related changes in funding mechanisms 
  3.20  and amounts. 
  3.21     Sec. 3.  [EFFECTIVE DATE.] 
  3.22     Sections 1 and 2 are effective the day following final 
  3.23  enactment.
