A bill for an act
relating to plumbing; modifying license, bond, and registration requirements
for well contractors; amending Minnesota Statutes 2008, section 326B.43,
subdivision 5.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 326B.43, subdivision 5, is amended to read:

Subd. 5.

Exemption.

new text begin (a) new text end No license or registration authorized by sections 326B.42
to 326B.49 shall be required of any individual engaged in or employed by a person
engaged in the work or business of pipe laying outside of buildings if such individual or
employer is engaged in a business or trade which has traditionally performed such work
within the state prior to January 1, 1994.

new text begin (b) No license, registration, or bond authorized by sections 326B.42 to 326B.49 shall
be required of a well contractor or limited well/boring contractor licensed and bonded
under section 103I.525 or 103I.531 engaged in the work or business of installing water
service pipe from a well to a pressure tank or water distribution source, or installing a
fixture or valve on the well water service pipe.
