  1.1                          A bill for an act 
  1.2             relating to emergency capital improvements; 
  1.3             authorizing state bonds; appropriating money to 
  1.4             replace facilities destroyed by fire on January 2, 
  1.5             2002, at Southwest State University in Marshall, 
  1.6             Minnesota.  
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [EMERGENCY APPROPRIATION; REPLACEMENT OF 
  1.9   FACILITY DESTROYED BY FIRE.] 
  1.10     $....... is appropriated from the bond proceeds fund to the 
  1.11  board of trustees of the Minnesota state colleges and 
  1.12  universities to replace and repair facilities at Southwest State 
  1.13  University that were destroyed and damaged by a fire on January 
  1.14  2, 2002.  The appropriation must be used to augment insurance 
  1.15  settlements to design, construct, furnish, and equip a food 
  1.16  service building at Southwest State University in Marshall, 
  1.17  Minnesota, and for repairs of other campus facilities damaged by 
  1.18  the fire. 
  1.19     Notwithstanding Minnesota Statutes, section 16B.33, or any 
  1.20  other law, the board may use a design-build method of project 
  1.21  development and construction for this project.  The board may 
  1.22  award a design-build contract on the basis of requests for 
  1.23  proposals or a two-step request for qualifications followed by 
  1.24  request for proposals without taking bids.  
  1.25     Sec. 2.  [BOND SALE.] 
  1.26     To provide the money appropriated in this act from the bond 
  2.1   proceeds fund, the commissioner of finance shall sell and issue 
  2.2   bonds of the state in an amount up to $....... in the manner, 
  2.3   upon the terms, and with the effect prescribed by Minnesota 
  2.4   Statutes, sections 16A.631 to 16A.675, and by the Minnesota 
  2.5   Constitution, article XI, sections 4 to 7. 
  2.6      Sec. 3.  [EFFECTIVE DATE.] 
  2.7      Sections 1 and 2 are effective the day following final 
  2.8   enactment.
