  1.1                          A bill for an act 
  1.2             relating to human health; requiring that all bovine 
  1.3             stock slaughtered in Minnesota under the state meat 
  1.4             inspection program be tested for bovine spongiform 
  1.5             encephalopathy; amending Minnesota Statutes 2002, 
  1.6             section 31A.04.  
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 31A.04, is 
  1.9   amended to read: 
  1.10     31A.04 [INSPECTION OF CARCASSES AND PARTS; MARKING; 
  1.11  DISPOSITION OF CONDEMNED CARCASSES.] 
  1.12     (a) Inspectors appointed by the commissioner for that 
  1.13  purpose shall make a postmortem examination and inspection of 
  1.14  the carcasses and parts of all animals usable as human food 
  1.15  prepared at a slaughtering, meat canning, salting, packing, 
  1.16  rendering, or similar establishment in this state in which 
  1.17  carcasses or parts are prepared solely for intrastate commerce.  
  1.18  Every carcass of a bovine animal over the age of 16 months must 
  1.19  be tested for bovine spongiform encephalopathy (BSE) and the 
  1.20  carcass must be held at the establishment until the BSE test 
  1.21  results are received.  Carcasses and parts of animals found to 
  1.22  be unadulterated must be marked, stamped, tagged, or labeled, as 
  1.23  "Inspected and Passed."  The inspectors shall label, mark, 
  1.24  stamp, or tag as "Inspected and Condemned" carcasses and parts 
  1.25  of animals found to be adulterated.  Carcasses and animal parts 
  1.26  inspected and condemned must be destroyed for food purposes by 
  2.1   the establishment in the presence of an inspector.  The 
  2.2   commissioner may remove inspectors from an establishment which 
  2.3   fails to destroy a condemned carcass or animal part.  
  2.4      (b) After the first inspection, inspectors shall, if they 
  2.5   consider it necessary, reinspect the carcasses or animal parts 
  2.6   to determine whether they have become adulterated since the 
  2.7   first inspection.  If a carcass or animal part is then found to 
  2.8   be adulterated, it must be destroyed for food purposes by the 
  2.9   establishment in the presence of an inspector.  The commissioner 
  2.10  may remove inspectors from an establishment which fails to 
  2.11  destroy a condemned carcass or animal part.  
  2.12     Sec. 2.  [EFFECTIVE DATE.] 
  2.13     Section 1 is effective for all bovine animals slaughtered 
  2.14  after September 30, 2004.
