  1.7             Session chapter 4, article 2, section 51, subdivision 
  1.8             29; repealing Minnesota Statutes 1996, section 
  1.9             124.2613, subdivision 8. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.12  124.2613, subdivision 3, is amended to read: 
  1.13     Subd. 3.  [QUALIFYING SCHOOL SITE.] (a) The commissioner 
  1.14  shall rank all school sites with kindergarten programs that do 
  1.15  not exclusively serve students under section 120.17.  The 
  1.16  ranking must be from highest to lowest based on the site's free 
  1.17  and reduced lunch count as a percent of the fall enrollment 
  1.18  using the preceding October 1 enrollment data.  Once a school 
  1.19  site is calculated to be eligible, it remains eligible for the 
  1.20  duration of the pilot program.  For each school site, the 
  1.21  percentage used to calculate the ranking must be the greater of 
  1.22  (1) the percent of the fall kindergarten enrollment receiving 
  1.23  free and reduced lunch, or (2) the percent of the total fall 
  1.24  enrollment receiving free and reduced lunch.  The list of ranked 
  1.25  sites must be separated into the following geographic areas:  
  1.26  Minneapolis district, St. Paul district, suburban Twin Cities 
  1.27  districts in the seven-county metropolitan area, and school 
  2.1   districts in greater Minnesota. 
  2.2      (b) The commissioner shall establish a process and 
  2.3   timelines to qualify school sites for the next school year.  
  2.4   School sites must be qualified in each geographic area from the 
  2.5   list of ranked sites until the estimated revenue available for 
  2.6   this program has been allocated.  The total estimated revenue 
  2.7   must be distributed to qualified school sites in each geographic 
  2.8   area as follows:  25 percent for Minneapolis sites, 25 percent 
  2.9   for St. Paul sites, 25 percent for suburban Twin Cities sites, 
  2.10  and 25 percent for greater Minnesota. 
  2.11     (c) School sites qualify according to the following 
  2.12  schedule: 
  2.13     (1) For fiscal year 1999, all school sites located in 
  2.14  Minneapolis, St. Paul, and greater Minnesota with more than 50 
  2.15  percent of their enrollment eligible for free and reduced-price 
  2.16  lunch qualify for revenue and all suburban school sites located 
  2.17  in districts with administrative offices in the seven-county 
  2.18  metropolitan area with more than 25 percent of their enrollment 
  2.19  eligible for free and reduced-price lunch qualify for revenue. 
  2.20     (2) For fiscal year 2000, all school sites located in 
  2.21  Minneapolis, St. Paul, and greater Minnesota with more than 40 
  2.22  percent of their enrollment eligible for free and reduced-price 
  2.23  lunch qualify for revenue and all suburban school sites located 
  2.24  in districts with administrative offices in the seven-county 
  2.25  metropolitan area with more than 20 percent of their enrollment 
  2.26  eligible for free and reduced-price lunch qualify for revenue. 
  2.27     (3) For fiscal year 2001, all school sites located in 
  2.28  Minneapolis, St. Paul, and greater Minnesota with more than 30 
  2.29  percent of their enrollment eligible for free and reduced-price 
  2.30  lunch qualify for revenue and all suburban school sites located 
  2.31  in districts with administrative offices in the seven-county 
  2.32  metropolitan area with more than 15 percent of their enrollment 
  2.33  eligible for free and reduced-price lunch qualify for revenue. 
  2.34     (4) For fiscal year 2002, all school sites located in 
  2.35  Minneapolis, St. Paul, and greater Minnesota with more than 20 
  2.36  percent of their enrollment eligible for free and reduced-price 
  3.1   lunch qualify for revenue and all suburban school sites located 
  3.2   in districts with administrative offices in the seven-county 
  3.3   metropolitan area with more than 10 percent of their enrollment 
  3.4   eligible for free and reduced-price lunch qualify for revenue. 
  3.5      (5) For fiscal year 2003, all school sites located in 
  3.6   Minneapolis, St. Paul, and greater Minnesota with more than ten 
  3.7   percent of their enrollment eligible for free and reduced-price 
  3.8   lunch qualify for revenue and all suburban school sites located 
  3.9   in districts with administrative offices in the seven-county 
  3.10  metropolitan area with more than five percent of their 
  3.11  enrollment eligible for free and reduced-price lunch qualify for 
  3.12  revenue. 
  3.13     (6) For fiscal years 2004 and later, all school sites 
  3.14  qualify for revenue. 
  3.15     Sec. 2.  Laws 1997, First Special Session chapter 4, 
  3.16  article 2, section 51, subdivision 29, is amended to read: 
  3.17     Subd. 29.  [FIRST GRADE PREPAREDNESS.] (a) For grants for 
  3.18  the first grade preparedness program under Minnesota Statutes, 
  3.19  section 124.2613, and for school sites that have provided a 
  3.20  full-day kindergarten option for kindergarten students enrolled 
  3.21  in fiscal years 1996 and 1997: 
  3.22       $5,000,000     .....     1998 
  3.23       $5,000,000 $28,411,000     .....     1999 
  3.24     (b) To be a qualified site, licensed teachers must have 
  3.25  taught the optional full-day kindergarten classes.  A district 
  3.26  that charged a fee for students participating in an optional 
  3.27  full-day program is eligible to receive the grant to provide 
  3.28  full-day kindergarten for all students as required by Minnesota 
  3.29  Statutes, section 124.2613, subdivision 4.  Districts with 
  3.30  eligible sites must apply to the commissioner of children, 
  3.31  families, and learning for a grant. 
  3.32     (c) This appropriation must first be used to fund programs 
  3.33  operating during the 1996-1997 school year under paragraph (b) 
  3.34  and Minnesota Statutes, section 124.2613.  Any remaining funds 
  3.35  may be used to expand the number of sites providing first grade 
  3.36  preparedness programs. 
  4.1      Sec. 3.  [REPEALER.] 
  4.2      Minnesota Statutes 1996, section 124.2613, subdivision 8, 
  4.3   is repealed. 
  4.4      Sec. 4.  [EFFECTIVE DATE.] 
  4.5      Sections 1 to 3 are effective July 1, 1998.
