  1.1                          A bill for an act 
  1.2             relating to energy; providing competitive bid 
  1.3             exemption for wind energy; amending Minnesota Statutes 
  1.4             2002, section 216B.2422, by adding a subdivision. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 216B.2422, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 7.  [WIND ENERGY EXEMPTION FROM COMPETITIVE 
  1.9   BIDDING.] (a) A public utility that is subject to a competitive 
  1.10  bidding requirement by the commission under subdivision 5 may 
  1.11  own, construct, and operate wind energy capacity without 
  1.12  complying with that requirement, to the extent the utility 
  1.13  purchases wind energy capacity from an independent wind energy 
  1.14  developer.  This exemption from competitive bidding is limited 
  1.15  to the number of megawatts of wind energy capacity the public 
  1.16  utility has purchased from an independent wind energy developer 
  1.17  after the effective date of this section. 
  1.18     (b) For the purposes of this section, wind energy capacity 
  1.19  from an independent producer means wind energy capacity that is 
  1.20  (1) generated in Minnesota by an entity other than a public 
  1.21  utility, municipality, or cooperative electrical association and 
  1.22  (2) above the amount required in sections 216B.1691, subdivision 
  1.23  6, paragraph (a), and 216B.2423, subdivisions 1 and 2.
