A bill for an act
relating to elections; requiring certain candidates for president and vice-president
to release federal income tax information; amending Minnesota Statutes 2018,
section 207A.13, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 207A.13, is amended by adding a subdivision
to read:

new text begin Tax return disclosure required. new text end

new text begin (a) No later than 63 days before the presidential
nomination primary, a candidate for presidential nomination must:

new text begin (1) publicly release a copy of the candidate's federal income tax returns, as defined in
United States Code, title 26, section 6103(b)(1), for at least the five most recent taxable
years for which a return has been filed with the internal revenue service; or

new text begin (2) file with the secretary of state:

new text begin (i) the federal tax returns as described in clause (1); and
new text end

new text begin (ii) written consent, in a form prescribed by the secretary of state, for the public disclosure
of such returns pursuant to this section.

new text begin (b) The secretary of state shall make tax returns filed or released under this section
publicly available on the secretary of state's website within seven days of receipt or release.
The secretary of state may make additional schedules or forms filed under this section
publicly available upon request. Prior to making any federal tax returns public, the secretary
of state shall redact such information contained in the returns as deemed needed in
consultation with the commissioner of revenue.

new text begin (c) Notwithstanding a party's determination under subdivision 2, a presidential candidate
who does not comply with the requirements of this subdivision may not appear on the
presidential nomination primary ballot.

new text begin (d) No later than 63 days before a general election for president, all candidates for
president and vice-president shall comply with paragraph (a). Notwithstanding section
208.04, subdivision 1, candidates for president or vice-president who do not comply with
paragraph (a) may not appear on the general election ballot.
