  1.1                          A bill for an act 
  1.2             relating to education; modifying student enrollment in 
  1.3             the postsecondary enrollment options program; 
  1.4             modifying the counseling requirements of the 
  1.5             postsecondary enrollment options program; amending 
  1.6             Minnesota Statutes 2002, section 124D.09, subdivisions 
  1.7             5, 6.  
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 124D.09, 
  1.10  subdivision 5, is amended to read: 
  1.11     Subd. 5.  [AUTHORIZATION; NOTIFICATION.] Notwithstanding 
  1.12  any other law to the contrary, an 11th or 12th grade pupil whose 
  1.13  score on the 10th grade Minnesota Comprehensive Assessment in 
  1.14  reading is defined as proficient, or has written permission from 
  1.15  the high school principal, enrolled in a school or an American 
  1.16  Indian-controlled tribal contract or grant school eligible for 
  1.17  aid under section 124D.83, except a foreign exchange pupil 
  1.18  enrolled in a district under a cultural exchange program, may 
  1.19  apply to an eligible institution, as defined in subdivision 3, 
  1.20  to enroll in nonsectarian courses offered by that postsecondary 
  1.21  institution.  If an institution accepts a secondary pupil for 
  1.22  enrollment under this section, the institution shall send 
  1.23  written notice to the pupil, the pupil's school or school 
  1.24  district, and the commissioner within ten days of acceptance.  
  1.25  The notice must indicate the course and hours of enrollment of 
  1.26  that pupil.  If the pupil enrolls in a course for postsecondary 
  2.1   credit, the institution must notify the pupil about payment in 
  2.2   the customary manner used by the institution. 
  2.3      [EFFECTIVE DATE.] This section is effective the day 
  2.4   following final enactment for postsecondary enrollment options 
  2.5   applications submitted on or after July 1, 2004.  
  2.6      Sec. 2.  Minnesota Statutes 2002, section 124D.09, 
  2.7   subdivision 6, is amended to read: 
  2.8      Subd. 6.  [COUNSELING.] (a) To the extent possible, the 
  2.9   school or school district must provide counseling services to 
  2.10  pupils and their parents or guardian before the pupils initially 
  2.11  enroll in courses under this section to ensure that the pupils 
  2.12  and their parents or guardian are fully aware of the risks and 
  2.13  possible consequences of enrolling in postsecondary courses.  
  2.14  The school or school district must provide information on the 
  2.15  program including who may enroll, what institutions and courses 
  2.16  are eligible for participation, the decision-making process for 
  2.17  granting academic credits, financial arrangements for tuition, 
  2.18  books and materials, eligibility criteria for transportation 
  2.19  aid, available support services, the need to arrange an 
  2.20  appropriate schedule, consequences of failing or not completing 
  2.21  a course in which the pupil enrolls, the effect of enrolling in 
  2.22  this program on the pupil's ability to complete the required 
  2.23  high school graduation requirements, and the academic and social 
  2.24  responsibilities that must be assumed by the pupils and their 
  2.25  parents or guardian.  The person providing counseling shall 
  2.26  encourage pupils and their parents or guardian to also use 
  2.27  available counseling services at the postsecondary institutions 
  2.28  before the quarter or semester of enrollment to ensure that 
  2.29  anticipated plans are appropriate.  
  2.30     (b) Prior to enrolling in a course, the pupil and the 
  2.31  pupil's parents or guardian must sign a form that must be 
  2.32  provided by the school or school district and may be obtained 
  2.33  from a postsecondary institution stating that they have received 
  2.34  the information specified in this subdivision and that they 
  2.35  understand the responsibilities that must be assumed in 
  2.36  enrolling in this program.  The department must, upon request, 
  3.1   provide technical assistance to a school or school district in 
  3.2   developing appropriate forms and counseling guidelines. 
  3.3      (c) If a pupil withdraws from a course or fails to maintain 
  3.4   a postsecondary grade point average of at least 2.0 on a 4.0 
  3.5   scale or its equivalent, the pupil must receive written 
  3.6   permission from the high school principal before enrolling in 
  3.7   subsequent postsecondary courses.  
  3.8      [EFFECTIVE DATE.] This section is effective the day 
  3.9   following final enactment for postsecondary enrollment options 
  3.10  applications submitted on or after July 1, 2004.
