relating to elections; providing for establishment of single-member school board
election districts in Independent School District No. 279, Osseo.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin The school board of Independent School District No. 279,
Osseo, must divide the school district into five single-member election districts, from which
one board member each must be elected. Two additional members must be elected at large.

new text begin Election district boundaries. new text end

new text begin Each election district must be as equal in
population as practicable and must be composed of compact, contiguous territory. The
district may use the most recent federal decennial census figures available or may conduct
a special census for this purpose. The board must designate each election district by number.

new text begin The board must specify the election districts from which
vacancies shall be filled as they occur until five board members represent an election district.
A candidate for school board in a subsequent election must file an affidavit of candidacy
to be elected as a school board member for the election district in which the candidate
resides, unless the candidate is filing for one of the at-large seats. Each board member who
files for election from an election district must be a resident of that district but the creation
of an election district or a change in election district boundaries does not disqualify a board
member from serving for the remainder of a term.

Sec. 2. new text begin LOCAL APPROVAL; EFFECTIVE DATE.

new text begin (a) Section 1 is effective the day after the governing body of Independent School District
No. 279, Osseo, and its chief clerical officer comply with Minnesota Statutes, section
645.021, subdivisions 2 and 3. Notwithstanding the time limit in Minnesota Statutes, section
645.021, subdivision 3, the governing body has until August 10, 2020, to comply with
Minnesota Statutes, section 645.021, subdivisions 2 and 3.

new text begin (b) If local approval has not been completed by August 11, 2020, the governing body
shall submit the question of approval to the voters of the school district at the 2020 general
election. The question submitted must be: "Shall Independent School District No. 279,
Osseo, be divided into five election districts, from which one member each must be elected,
with two additional members elected at large?" If approved by a majority of the voters
voting on the question, section 1 is effective the day after the canvassing board certifies the
result of the election.
