  1.1                          A bill for an act
  1.2             relating to health; directing the commissioner of 
  1.3             health to exempt certain public pools from the 
  1.4             standards for pools with diving. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [RULES RELATING TO STANDARDS FOR PUBLIC POOLS 
  1.7   WITH DIVING.] 
  1.8      Subdivision 1.  [PUBLIC POOLS IN EXISTENCE AS OF JANUARY 4, 
  1.9   1995; EXEMPTION FROM RULES.] The commissioner of health shall 
  1.10  grant an exemption from the standards for pools with diving 
  1.11  contained in Minnesota Rules, part 4717.3750, upon receiving an 
  1.12  application for an exemption from an owner of a public pool that 
  1.13  was in existence as of January 4, 1995.  Public pools that 
  1.14  receive an exemption are governed by the minimum standards for 
  1.15  public swimming pools diving area contained in Minnesota Rules 
  1.16  1993, part 4717.3900. 
  1.17     Subd. 2.  [DUTIES OF THE COMMISSIONER.] The commissioner of 
  1.18  health shall amend Minnesota Rules, part 4717.3750, to conform 
  1.19  with subdivision 1.  For public pools for which an exemption is 
  1.20  granted, the commissioner shall readopt the minimum standards 
  1.21  for public swimming pools diving area contained in Minnesota 
  1.22  Rules 1993, part 4717.3900.  The commissioner may amend and 
  1.23  adopt rules required by this section according to Minnesota 
  1.24  Statutes, section 14.388. 
  1.25     Sec. 2.  [EFFECTIVE DATE.] 
  2.1      Section 1 is effective the day following final enactment.
