A bill for an act
relating to animals; establishing an animal abuser registry; requiring
the commissioner of public safety to post identifying information on the
commissioner's Web site; appropriating money; proposing coding for new law in
Minnesota Statutes, chapter 343.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) For purposes of this section, the terms defined in this
subdivision have the meanings given them.

new text begin (b) "Animal" means a pet or companion animal as defined under section 343.20,
subdivision 6. Animal does not mean an agricultural or farm animal used for food or other
products or any other agricultural use, or wildlife as defined in section 97A.041.

new text begin (c) "Animal abuse offense" means a felony conviction under section 343.21, a felony
conviction under section 343.31, or a gross misdemeanor conviction under section 609.294.

new text begin (d) "Animal abuser" means a person convicted in this state of committing an animal
abuse offense.

new text begin (e) "Commissioner" means the commissioner of public safety.

new text begin (f) "Conviction" has the meaning given in section 609.02, subdivision 5, and
includes a stay of adjudication or a referral to diversion, notwithstanding any pending
appeal or habeas corpus proceeding arising from the judgment.

new text begin (a) Beginning January 1, 2017, the commissioner
shall post on the commissioner's Web site a publicly accessible list including each person
convicted of an animal abuse offense on or after that date.

new text begin (b) The list shall include a photograph taken of the animal abuser as part of the
booking process, the animal abuser's full legal name, and other identifying data that the
commissioner determines necessary to properly identify the animal abuser and to exclude
innocent persons.

new text begin (c) A law enforcement agency must provide a photograph of an animal abuser to
the commissioner upon request.

new text begin (a) Upon a person's first conviction for an animal abuse offense,
the commissioner shall maintain the person's name and other identifying information on
the list for four years following the date of conviction, after which time the commissioner
shall remove the person's name and identifying information from the list unless the person
is convicted of another animal abuse offense during that four-year period.

new text begin (b) Upon a person's subsequent conviction for an animal abuse offense, the
commissioner shall maintain the person's name and other identifying information on the
list for eight years following the date of the most recent conviction, after which time the
commissioner shall remove the person's name and identifying information from the list
unless the person is convicted of another animal abuse offense during that eight-year period.
