  1.1                          A bill for an act 
  1.2             relating to liquor; providing for the issuance of 
  1.3             intoxicating liquor licenses to tour boats on the St. 
  1.4             Croix river and Mississippi river; amending Minnesota 
  1.5             Statutes 1994, sections 340A.404, subdivision 8; 
  1.6             340A.408, subdivision 4; and 340A.413, subdivision 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 340A.404, 
  1.9   subdivision 8, is amended to read: 
  1.10     Subd. 8.  [LAKE SUPERIOR, ST. CROIX RIVER, AND MISSISSIPPI 
  1.11  RIVER TOUR BOATS.] (a) The commissioner may issue an on-sale 
  1.12  intoxicating liquor license to a person regularly engaged, on an 
  1.13  annual or seasonal basis, in the business of offering tours by 
  1.14  boat on Lake Superior and adjacent bays, the St. Croix river, 
  1.15  and the Mississippi river.  The license shall authorize the sale 
  1.16  of intoxicating liquor for consumption on the boat while 
  1.17  underway or attached to a dock or other mooring.  No license may 
  1.18  be issued unless each boat used in the tour business regularly 
  1.19  sells meals in the place where intoxicating liquor is sold. 
  1.20     (b) All sales of intoxicating liquor made on a boat while 
  1.21  it is attached to a dock or other mooring are subject to any 
  1.22  restrictions on the sale of liquor prescribed by the governing 
  1.23  body of the city where the boat is attached, or of a county when 
  1.24  it is attached outside a city.  A governing body may prohibit 
  1.25  liquor sales within its jurisdiction but may not require an 
  1.26  additional license, or require a fee or occupation tax, for the 
  2.1   sales.  
  2.2      (c) If a boat is moored for a period of at least three 
  2.3   consecutive months, the city may require the boat to obtain an 
  2.4   on-sale intoxicating liquor license from the city, and the fee 
  2.5   charged for the license must not exceed one-half the fee charged 
  2.6   for a comparable annual on-sale intoxicating liquor license. 
  2.7      Sec. 2.  Minnesota Statutes 1994, section 340A.408, 
  2.8   subdivision 4, is amended to read: 
  2.9      Subd. 4.  [LAKE SUPERIOR, ST. CROIX RIVER, AND MISSISSIPPI 
  2.10  RIVER TOUR BOATS; COMMON CARRIERS.] (a) The annual license fee 
  2.11  for licensing of Lake Superior, St. Croix river, and Mississippi 
  2.12  river tour boats under section 340A.404, subdivision 8, shall be 
  2.13  $1,000. 
  2.14     (b) The annual license fee for common carriers licensed 
  2.15  under section 340A.407 is: 
  2.16     (1) $50 for 3.2 percent malt liquor, and $20 for a 
  2.17  duplicate license; and 
  2.18     (2) $200 for intoxicating liquor, and $20 for a duplicate 
  2.19  license. 
  2.20     Sec. 3.  Minnesota Statutes 1994, section 340A.413, 
  2.21  subdivision 4, is amended to read: 
  2.22     Subd. 4.  [EXCLUSIONS FROM LICENSE LIMITS.] On-sale 
  2.23  intoxicating liquor licenses may be issued to the following 
  2.24  entities by a city, in addition to the number authorized by this 
  2.25  section: 
  2.26     (1) clubs, or congressionally chartered veterans 
  2.27  organizations; 
  2.28     (2) restaurants located at a racetrack licensed under 
  2.29  chapter 240; 
  2.30     (3) establishments that are issued licenses to sell wine 
  2.31  under section 340A.404, subdivision 5; 
  2.32     (4) Lake Superior, St. Croix river, and Mississippi river 
  2.33  tour boats that are issued licenses under section 340A.404, 
  2.34  subdivision 8; and 
  2.35     (5) theaters that are issued licenses under section 
  2.36  340A.404, subdivision 2.
