A bill for an act
relating to transportation; modifying certain requirements governing priced
highway lanes; amending Minnesota Statutes 2010, section 160.93, by adding
subdivisions.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 160.93, is amended by adding a
subdivision to read:

new text begin (a) For purposes of this subdivision,
"double white lines" means longitudinal pavement markings that consist of two solid
white lines (1) placed in parallel, (2) placed in close proximity to one another, and (3)
separated by a discernible space.

new text begin (b) Consistent with the specifications established under section 169.06, subdivision
1, the commissioner may delineate a priced lane by placing double white lines.

new text begin (c) The commissioner may not prohibit crossing double white lines established
under paragraph (b) to enter or exit a priced lane, outside of the times of day in which the
fee authorized under subdivision 1 is in effect.

Sec. 2.

Minnesota Statutes 2010, section 160.93, is amended by adding a subdivision
to read:

new text begin If the commissioner designates a priced lane along
marked Interstate Highway 35W, for any portion of the segment from its intersection with
marked Interstate Highway 94 to the point where it intersects with marked Interstate
Highway 35E:

new text begin (1) the morning hours in which lane pricing is established (i) may not commence
before 6:00 a.m., and (ii) may not continue past 9:00 a.m.; and

new text begin (2) the afternoon and evening hours in which lane pricing is established (i) may not
commence before 3:00 p.m., and (ii) may not continue past 6:00 p.m.
