  1.1                          A bill for an act 
  1.2             relating to data practices; permitting the release of 
  1.3             reserved library books to third parties; amending 
  1.4             Minnesota Statutes 1994, section 13.40, subdivision 2. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 13.40, 
  1.7   subdivision 2, is amended to read: 
  1.8      Subd. 2.  [PRIVATE DATA; LIBRARY BORROWERS.] (a) Except as 
  1.9   provided in paragraph (b), The following data maintained by a 
  1.10  library are private data on individuals and may not be disclosed 
  1.11  for other than library purposes except pursuant to a court order:
  1.12     (1) data that link a library patron's name with materials 
  1.13  requested or borrowed by the patron or that link a patron's name 
  1.14  with a specific subject about which the patron has requested 
  1.15  information or materials; or 
  1.16     (2) data in applications for borrower cards, other than the 
  1.17  name of the borrower. 
  1.18     (b) A library may release a reserved book to a family 
  1.19  member of a library patron or a person who resides with a 
  1.20  library patron who is picking up the book on behalf of the 
  1.21  patron.
