  1.1                          A bill for an act 
  1.2             relating to health; allowing family planning agencies 
  1.3             to refuse to accept the duty of offering certain 
  1.4             family planning services; amending Minnesota Statutes 
  1.5             2002, section 145.925, subdivision 6. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 145.925, 
  1.8   subdivision 6, is amended to read: 
  1.9      Subd. 6.  [PUBLIC SERVICES; INDIVIDUAL AND, EMPLOYEE, AND 
  1.10  AGENCY RIGHTS.] (a) The request of any person for family 
  1.11  planning services or the refusal to accept any service shall in 
  1.12  no way affect the right of the person to receive public 
  1.13  assistance, public health services, or any other public 
  1.14  service.  Nothing in this section shall abridge the right of the 
  1.15  individual to make decisions concerning family planning, nor 
  1.16  shall any individual be required to state a reason for refusing 
  1.17  any offer of family planning services. 
  1.18     (b) Any employee of the agencies engaged in the 
  1.19  administration of the provisions of this section may refuse to 
  1.20  accept the duty of offering family planning services to the 
  1.21  extent that the duty is contrary to personal beliefs.  A refusal 
  1.22  shall not be grounds for dismissal, suspension, demotion, or any 
  1.23  other discrimination in employment.  The directors or 
  1.24  supervisors of the agencies shall reassign the duties of 
  1.25  employees in order to carry out the provisions of this section. 
  2.1      (c) Any agencies engaged in the administration of the 
  2.2   provisions of this section may refuse to accept the duty of 
  2.3   referring for or offering family planning services to the extent 
  2.4   that the duty is contrary to the religious or moral beliefs of 
  2.5   the agency.  If an agency refuses to accept the duty of 
  2.6   referring for or offering some family planning services, the 
  2.7   commissioner must not penalize the agency's application for 
  2.8   family planning special projects grants. 
  2.9      (d) All information gathered by any agency, entity, or 
  2.10  individual conducting programs in family planning is private 
  2.11  data on individuals within the meaning of section 13.02, 
  2.12  subdivision 12.
