  1.1                          A bill for an act 
  1.2             relating to human services; establishing a floor for 
  1.3             nursing facility operating cost reimbursement; 
  1.4             amending Minnesota Statutes 1998, section 256B.431, by 
  1.5             adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 256B.431, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 29.  [CHANGES TO NURSING FACILITY REIMBURSEMENT 
  1.10  BEGINNING JULY 1, 2000.] (a) For the rate year beginning July 1, 
  1.11  2000, the commissioner shall adjust operating costs per diem for 
  1.12  nursing facilities reimbursed under this section and section 
  1.13  256B.434 as provided in this subdivision. 
  1.14     (b) For each nursing facility, the commissioner, after 
  1.15  applying the adjustment in subdivision 28, shall compare the 
  1.16  operating costs per diem listed in this paragraph to the 
  1.17  operating costs per diem the facility would otherwise receive 
  1.18  for the July 1, 2000, rate year.

  2.6      (c) If a facility's total reimbursement for operating 
  2.7   costs, using the case mix classification operating costs per 
  2.8   diem listed in paragraph (b), is greater than the total 
  2.9   reimbursement for operating costs the facility would otherwise 
  2.10  receive, the commissioner shall calculate operating costs per 
  2.11  diem for that facility for the rate year beginning July 1, 2000, 
  2.12  using the case mix classification operating costs per diem 
  2.13  listed in paragraph (b). 
  2.14     (d) If a facility's total reimbursement for operating 
  2.15  costs, using the case mix classification costs per diem listed 
  2.16  in paragraph (b), is less than the total reimbursement for 
  2.17  operating costs the facility would otherwise receive, the 
  2.18  commissioner shall reimburse that facility for the rate year 
  2.19  beginning July 1, 2000, as provided in this section or section 
  2.20  256B.434, whichever is applicable, and shall not calculate 
  2.21  operating costs per diem for that facility using the case mix 
  2.22  classification operating costs per diem listed in paragraph (b).
