  1.1                          A bill for an act 
  1.2             relating to education; modifying the sexually 
  1.3             transmitted diseases program to include promoting 
  1.4             marriage; amending Minnesota Statutes 2000, section 
  1.5             121A.23, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 121A.23, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [MARRIAGE AND SEXUALLY TRANSMITTED DISEASES 
  1.10  PROGRAM.] 
  1.11     The commissioner of children, families, and learning, in 
  1.12  consultation with the commissioner of health, shall assist 
  1.13  districts in developing and implementing a program to promote 
  1.14  marriage and prevent and reduce the risk of sexually transmitted 
  1.15  infections and diseases, including but not exclusive to human 
  1.16  immune deficiency virus and human papilloma virus.  Each 
  1.17  district must have a program that includes at least: 
  1.18     (1) educating students on the value of marriage and a 
  1.19  discussion of the historical purpose and significance of 
  1.20  marriage.  That among others, marriage is the foundational 
  1.21  social institution in society; central to the nurturing and 
  1.22  raising of children; important to the emotional, physical, and 
  1.23  economic well-being of men, women, and children; 
  1.24     (2) educating students that abstinence from sexual activity 
  1.25  outside of marriage and fidelity within marriage is the expected 
  2.1   standard for sexual behavior; 
  2.2      (3) educating students that sexual activity outside of the 
  2.3   context of marriage is likely to have harmful emotional, 
  2.4   physical, and social effects; 
  2.5      (4) planning materials, guidelines, and other technically 
  2.6   accurate and updated information; 
  2.7      (2) (5) a comprehensive, technically accurate, and updated 
  2.8   curriculum that includes helping students to abstain from sexual 
  2.9   activity until marriage; 
  2.10     (3) (6) cooperation and coordination among districts and 
  2.11  SCs; 
  2.12     (4) (7) a targeting of adolescents, especially those who 
  2.13  may be at high risk of contracting sexually transmitted 
  2.14  infections and diseases, for prevention efforts; 
  2.15     (5) (8) involvement of parents and other community members; 
  2.16     (6) (9) in-service training for appropriate district staff 
  2.17  and school board members; 
  2.18     (7) (10) collaboration with state agencies and 
  2.19  organizations having a sexually transmitted infection and 
  2.20  disease prevention or sexually transmitted infection and disease 
  2.21  risk reduction program; 
  2.22     (8) (11) collaboration with local community health 
  2.23  services, agencies and organizations having a sexually 
  2.24  transmitted infection and disease prevention or sexually 
  2.25  transmitted infection and disease risk reduction program; and 
  2.26     (9) (12) participation by state and local student 
  2.27  organizations. 
  2.28     The department may provide assistance at a neutral site to 
  2.29  a nonpublic school participating in a district's program.  
  2.30  District programs must not conflict with the health and wellness 
  2.31  curriculum developed under Laws 1987, chapter 398, article 5, 
  2.32  section 2, subdivision 7. 
  2.33     If a district fails to develop and implement a program to 
  2.34  promote marriage and prevent and reduce the risk of sexually 
  2.35  transmitted infection and disease, the department must assist 
  2.36  the service cooperative in the region serving that district to 
  3.1   develop or implement the program.
